That's not actually true. They weren't certified in the US, and thus they were recalled, which is not the same thing as failing certification (just like not taking the SATs doesn't mean you're stupid...). However, they pass EU safety standards and are kosher in Canada (where I bought mine). I'm under the impression that the EU standards are actually higher than the US ones, but I could be wrong.
