I find it funny that this last weekend they were selling burritos for $3 to anyone who came in dressed in a costume of something unnecessary to promote the fact that they'd removed all preservatives from their menu while a foodborne illness outbreak was going on at their stores. Yeah, that's the part I don't get. If you quit or are fired for cause, I can see them having the right to be able to restrict your ability to take their secrets to a competitor, but, when you are laid off, that implies they don't need your job function anymore (or are unable to pay for you to do it), so they shouldn't be able to restrict your ability to work.

If a city has too many auto mechanics enough eventually have to close shop, not enough business to go around.

For every attorney that passes the bar, another attorney is needed to defend against the litigation of the first. A vicious cycle.

So my new boss gave me his old bike today. 90s Trek 2300. Bought a lock, seat pack, multitool, tire levers, found my spare frame pump, ordered a new niterider mount, WD40'd the brifter levers until the front one shifts and the rear shifts through the smaller half of the cogs, kind of. Put on my spare toe strap pedals. Yay, I get to ride to the train for work again! And it's carbon, except for the joints. Only feels a few lbs heavier than my old bike with 20 oz less water.

If you WD40 the cables and make sure it gets into the housings the shifting might get better. Then again, just using the shifters might free them up more.

If the bike fits and you plan on keeping it and using it as a commuter, new cable and housings, chain, cassette, and probably tubes and tires would be a good idea. It's probably an eight-speed, so you'd be looking at <$150 if you got that stuff online.

Unfortunately yes. Courts do look at the reasonableness of the restriction, and the amount of severance and whether you quit are practical considerations that could sway a judge. But a well drafted, closely tailored non-compete can be enforced even if you're laid off.

I'm going to be interested in seeing how well the new guys handle this. There are various hoops that you have to jump through to get a valid release under the Older Worker Benefits Protection Act. I was the guy who did all the non-competes, and separation agreements for the company. It's possible the new guys will screw it up.

It's nice of them to offer you business should you go the private route. I don't know how it is in your field but I find in the tech industry being a sole proprietor often feels more secure than working directly for a company. Things change so quickly that unless you're doing real essential stuff (dba voodoo) it pays to diversify income streams. Good luck in any case, i'm sure it'll work out.

So what you're saying is that because you did it, you made them ironclad with no way out? Or that because you set them up, you know all the loopholes and secret backdoors you put in that you could exploit if you needed to?

Lawyers (those in legislatures, and judges) make the rules. So Lawyers make rules that benefit them. There's a pretty good argument that non-competes aren't enforceable to restrict lawyers from practicing law.

I did point that out to my boss, before signing the non-compete. There are a few other problems with the application of our standard form as applied to my particular situation. I didn't bother to point those out, yet.

was warming up to do a workout this morning when i heard sirens up ahead. saw lots of cars stopped and a car on the median so i figured it was just car crash, but when i got closer i saw a crumpled bike and bloody rider covered with a tarp. got pretty shook after that and just rode home. its a really stupid section of road right before a highway where the bike lane ends and you need to cross over like 3 lanes of traffic to get back on it. it was after sunrise and there's tons of visibility so i didn't think it would be that dangerous, but i guess drivers don't think to look for bikes on their left side all of a sudden. really ****ty. @Ygduf travels this section (old page mill to arastradero) frequently - be safe.

I heard about that on the news but haven't sought out the rider's name. I don't want to go to another funeral so soon.

The wound is just fresh from Allen getting killed at the TT. The funeral was only 3 weeks ago. The direction of travel sort of indicates a non-commuter. I'm selfishly really hoping it's no one I know.

Hey all, I hope all is going well around here. I landed a dream job after a very brief (and anticipated) layoff in late July. Family is doing great -- but I'm coaching 3 teams, so with the new-ish job, I don't have much time. Unfortunately the job came with a commute too, but other than that, it's awesome.

Most of 2015 was very low training b/c of my last job, threshold had dropped to about 240W. I'm pretty solid on 5-6 good rides/week again for the last 3 months, and things are starting to look up for fitness. I might get my racing license again next year...

13-year-old son has his first girlfriend and just made the soccer team. 12-year-old daughter is growing like a weed and killing it in school. 10-year-old son is probably going to be an engineer, and might be the best mini-rc helicopter pilot around. My wife and I are just along for the ride. One team I'm coaching is fourteen 11/12 y/o girls -- they are a great group, and a lot of fun, but I think I age 3 hours for every hour on the field.

Good to hear from you waterrockets. Glad your family is doing so well. Coaching 3 soccer teams! That is a ton of work. I coached one for a while and it was tough.
