In the state of California if you open your car door and someone hits it (a bike or another car) it's automatically your falt for not looking before opening your car door. So the jerk is definately at fault. Hope you can get some cash out of the guy. If the bike was damaged at all, his insurance should fix it.
My question is: if you're riding brakeless and you get in an accident, is it possible for the person you hit to claim that it's your fault because you didn't have breaks even if they were at fault. Has this ever happened to anyone?
