This is the answer I got from the person, who maintains Ken' site:

Hi .... I think the trial is still pending. These things move very
slowly. But I can tell you that Ken's ashes were buried next to his
father. His son did consider sprinkling his ashes in the woods that he
loved, but Ken had requested to be buried next to his father a few years
earlier when his father had died, so he honored that request. He was
buried with his copy of Walden and one of his cycling shirts.
