it could be the speed limit
it is whatever the rider is comfortable with

In the link that I posted earlier, it is amazing the type of mindset that some insurance officials exhibit. One would think that all insurance companies would consider that this as an open and shut case, but again referring to the link that I posted, that doesn't seem to be the case in every auto/bicycle collisions.
