Uh, wrong on the face of it. I walk and ride on this very same "dark path."

MOST trail users are considerate. SOME are not.

Most lights are in fact not "too bright." Some lights are in fact WAY TOO BRIGHT.

Most bicycle headlights have so much "spillage" to begin with, and adding more lumens just acerbates the problem of blinding oncoming traffic. I tried different lens patterns for the type of bicycle headlamp that I use, but none really addressed the issue of light spillage, making me unable to use my bicycle headlamp to it's fullest output on much of my night commutes.

Even with flashing brake lights legal in Cailf, my area is a virtual desert when in comes to flashing brake lights, and the vehicles that had flashing brake lights, I found them as annoying as hell in slow stop and go traffic situations. So add a continual flashing, improperly aimed, high powered focused beam to the mix, especially in a low light situation, that could cause a situation to end up being more than just annoying.

The last, if not only time I ran all lights flashing at all was last week, and I spent most of that time WALKING it. Got a ride home, and the only reason I tried was because I had a new pair of longjohns held at the department store, they were the last pair in my size and I was dealing with stuff I bought more than 6 years earlier then I was 50 lbs. and THREE sizes larger.


We haven't had a real winter in years, until now. I still don't have a proper coat for that. Clown suit.

Poor mr. bill's magic is not so great after all. You sound like a lawyer I watched whining about a judge who cited an unpublished case.

If I ever do get ticketed, then I will spend the time to find the case and expand the case law to the 9th circuit.

At least my case law in favor of commuting and utility cyclist did get published.

Hawaii recreational use statute immunized federal government from liability for negligence for injuries sustained at urban swimming pool. 945 F.2d 1134.
U.S. government immune from negligence liability under Hawaii recreational use statute (HRUS) for personal injuries suffered by plaintiff while plaintiff was using a military recreational facility, where (1) because the government did not impose a "charge" or "fee" for plaintiff to enter upon and use the recreational facility, plaintiff's use of the government's property was "without charge" under the statute; (2) the fact that dock on which plaintiff was injured was closed to everyone except the instructors and students of the sailing course on day of plaintiff's injury did not strip the government of its HRUS immunity; (3) plaintiff argued that legislative history indicated that HRUS was not intended to immunize businesses from liability to their business invitees, there was no need to resort to statute's legislative history in search of an exception that was clearly not included; and (4) although plaintiff may have had professional as well as personal reasons for taking the sailing course, plaintiff's alleged "professional" motivation did not convert plaintiff into a "nonrecreational" user; plaintiff's subjective intent was, in the situation, immaterial. 181 F.3d 1064.
United States' motion for summary judgment denied, where United States had not demonstrated that Hawaii recreational use statute exempted it from negligence liability to plaintiff stemming from plaintiff's accident on Pearl Harbor bike path while traveling to work by bicycle; plaintiff raised a material issue of fact as to whether plaintiff was a recreational user of the bike path. 180 F. That cannot be! mr. bill says those lights are not that bright.

It's not the brightness of the light, but the repetitive flash then steady light cycles that were annoying in long term slow stop and go,low light situations.
