theres so much wrong with this i dont even know where to start.
Notice it says invalid ordinaces as in these are out side the ohio law. Meanign the laws them selves in this city are illegal in ophio. You get ticketed for a violation of these ordinances you contest it the ticket will be tossed out.

377.06 RIDING ON STREETS
It shall be legal to ride a bicycle or tricycle upon a street or public way, subject to the following:
(a) Every person operating a bicycle or tricycle upon a roadway shall ride within three feet of the right edge of the roadway when practicable, obeying all traffic rules applicable to vehicles and exercising due care when passing a standing vehicle or one proceeding in the same direction.
(b) Persons riding bicycles or tricycles upon a roadway shall ride single file in a single lane, except on paths or parts of roadways set aside for the exclusive use of bicycles or tricycles. (Ord. 84-88. Passed 9-4-84.)
(c) Wherever a designated path for bicycles and tricycles has been provided adjacent to a street, bicycle and tricycle riders shall use such path and shall not use the street. At no time shall a bicyclist or tricyclist under the age of seven operate a bicycle or tricycle on a street.
(d) No person shall ride a bicycle or tricycle on the pavement or berm of major streets that are posted as prohibiting bicycle riding. Those posted streets shall be designated by the Mayor or Director of Public Safety.
Note: Important transportation streets that are posted "no-bikes", include Clague, Columbia, and Dover Center Roads. This is a partial "sidewalk law" in disguise!

In avon this would mean getting off your bike about every 30 secounds and crossing between 2 and 6 trafic lanes. Essentially you would not get any where and i think thats sort of the point. They simply dont want cyclists there. To bad so sad "judge i contest this ticket based on the fact that avon's local ordinaces are against ohio law. I there for request that this ticket be dismissed and that i be re emburded for cout costs and lost wages by the city of avon" Know what the response would be to that "judge so ordered and case dismissed <Whack> nexts" avon best bbe re thinking their wittle local laws if their still on the books soon after sept 15 of this year they could face some hefty fines. New ohio law will not only make tickets from these local laws imidiatly void in court if contested but will infact make it flat out against the law to give a ticket to enforce them.

A person operating a bicycle shall ride upon the sidewalk rather than the roadway when sidewalks are available, except that no person shall ride a bicycle upon a sidewalk upon or along which signs have been erected by authority of Council or other duly designated local authority prohibiting such bicycle riding, or within a business district. At no time shall a person under the age of 11 years operate a bicycle on a street.
474.07 SAFE RIDING REGULATIONS FOR BICYCLES.
(a) Whenever a designated usable path for bicycles has been provided adjacent to a street, bicycle riders shall use such path and shall not use the street.
(c) No person shall ride a bicycle across or through any intersection involving a through street. Such intersections are to be crossed by walking the bicycle across or through the intersection.


Whats realy sad is there is quite a large list of these moronic laws on the books. And many people who ride in these cities do not relize they can even contest the tickets and win. So these cities had continued to hand them out.

And you thought i was kidding about how bad cycling could be in ohio. But then theres the upside to cycling in ohio. We have so many great parks with well developed scenic roads through these parks that are well to very well maintained. Then theres the litterly 1000s of great roads to ride on like eatern one of my fave places to ride or riding on the streets running parralel to easter. We got some great and varaied terrain here for riding. I guess after sept 15 this year thigns will change alot in ohio at least I hope so.

Hm....I say get a mountain bike. Those are some crazy laws.

Yep that be the one i mean heheh.

See right now they are just considered invalid. After the law goes in to effect they go from being invalid to illegal. Big diffrence there. As it stand say i was in avon riding got a ticket and did not contest it. I would have to pay the fine. This could be to say not being able to take time off of work to go to court. This is why these cities put these ordinances on the books. How ever if i go to court and contest the ticket its rendered oid and i do not pay court costs in some cases i could also as in my to bad so sad bit even get the city forced to pay me for lost wages and court costs. The loosing party always pays court costs.

With hb389 in effect this changes. The city can no longer hand out tickets for violating the ordinaces at all. Infact they could be fined if they do. Im not talking some $250 fine ither more like $100k

Obviously i have no idea what penalties for cities ticketign for their current invalid local ordinaces will be. The state could get creative and turn a ticket in to a check if you receive one. It all depends on what the first judge decides in the first contested ticket case. That judge is going to have god like power over the cities with these illegal ords.

I hope that first judge is a rabid cycling advocate. Ill tell you one thign if the judge does decide to do somethign crazy like turn that ticket in to a check guess where ill be the very next day in avon and avon lake to rack me up some tic.... checks

Heh well the cities will and do loose in contested tickets over them every single time. With hb 389 they are not able to legally hand them out. Im not sure but i beleive even now they can not add any more invalid ords or local laws like that with ut getting in trouble with the state.

From what i understand taft is quite the avid cyclist himself. I emailed him today about some other isues in ohio so we shall see what happens. No reply as of yet my guess from the lack of a response imidiatly (aka autosponder) is he reads the emails him self or has them dictated to tape.
