Prison for killing cyclist..

From the Poughkeepsie Journal - Poughkeepsie , NY.
"A Putnam County man faces up to three years in state prison after admitting today he fatally injured a bicyclist on a highway in East Fishkill when he hit him with his van last year.

William Mancusi, 32, of Carmel, entered a guilty plea in Dutchess County Court to vehicular manslaughter, a felony. He admitted causing the death of 48-year-old Alfred Poggiogalle of Hopewell Junction.

Responding to questions from Senior Assistant District Attorney Edward Whitesell, Mancusi acknowledged he had smoked marijuana and ingested morphine before he drove his van on Route 52 on the evening of June 12, 2008.

“And you admit that by ingesting these drugs, you operated your vehicle in a manner that caused the death of Alfred Poggiogalle?” Whitesell asked.

“Yes,” Mancusi replied.

The crime carries a maximum sentence of 2 1/3 to seven years in state prison. In exchange for his plea, County Court Judge Thomas J. Dolan said he would impose a one-to-three-year sentence.

Mancusi was jailed without bail pending his sentencing, scheduled for June 25." (end)

I dont know how long the link will stay up, but here it is if anyone wishes :

One to Three years is nowhere near enough time.

I agree, not enough time. Of course, without the drug charge, he probably would have gotten off with community service or even just a few hundred dollars fine.

If he has any priors for DUI, he should get a lifetime driving ban too.

I wonder what the range of penalties would be if he had killed somebody driving their car... Any different?

^ I hope not. Good thing I am ignorant of such specifics or I'd be pissed.

Unless a new law appeared within a few months titled "[insert accident victim here]'s law", I doubt it.

Welcome to the forum. Bikers ride motorcycles. Cyclists ride bikes. Not intuitive; just the way it is.

Probably true.
However, it isn't out of line for the crime.

Here's a drunk driver that killed FOUR people in another CAR (not cyclists) who only faces 6 years total for killing four people (1.5 years per person killed).

https://mynorthwest.com/?nid=11&sid=277141

Of course, none of the comments complain about the dead drivers being on the road in the first place or that the only thing they do is muck up traffic, or never obey traffic signals.

For the record, (to be) first lady Laura Bush/Welch killed someone in a car after running a stop sign and was not cited.

A tad elitist for someone with 40 posts, maybe.

Somehow killing a cyclist is less terrible than killing another motorist.

I'm sorry... I believe we have too many people locked up in our prison system.

This was an accident. No intent to kill. I don't have the whole story Hit & Run?

We don't need to have society pay to hold him in prison
  • Put him on parole... for 5 to 10 years.
  • Require... 1000 hours of community service. 5000 hours?
  • Require regular AA or Narcotics Anonymous meetings (or a similar rehab program, I don't agree with the AA ideals).
  • Allow random spot-checks of his house, vehicle, breath, and urine for alcohol & drugs (or empty containers).
  • Ankle bracelet?
And, if he messes up again, then send him to prison.

I don't know the entire history, but it would depend on the number of offenses.

I think he should have been give 3-5 years. I agree with cliffordk in we do have too many people in prison, but this wasn't an "accident" in the traditional use of the word. Had the driver, been sober, and not on drugs you can use the term accident. However having smoked marijuana and ingested morphine and THEN driving he clearly needs to serve time plan and simple.

Plot twist Dezc511 is William Mancusi, who, having long served his time, recently decided to google himself.

One dead cyclist is enough!
If this guy was still in prison, we would all be safer and there would be less suffering for the cyclist family.
