I hope the admission that he was using his cell phone adds to the penalty. In some states, it would count as 'aggravated' or 'reckless' to whatever charges he was already facing.

Lets see, he was looking at his cell phone, hit something hard enough to break the windshield, did not notice what he hit and kept on going. I think the prosecution should be able to add perjury to the charges. The defendants claims are beyond the stupid, have traversed into pure fantasy. How many of you would smash out your windshield and not stop so see what hit you?

This is illegal in VA. Has been for a couple years now. Also illegal in MD and DC.

I believe this is incorrect. Not illegal in VA. Only for minors, novice drivers, and school bus drivers. MD is correct.

To me, this says that he saw the cyclist just before he swerved, hit her, and had NO second thoughts about running.

Vaughan said that moments later he saw the Durango swerve “violently to the left” up ahead and then accelerate. The brothers saw debris along the road and stopped, and William Vaughan helped turn Kruszewski’s body over and checked in vain for a pulse.
Brett Beatty testified that he was driving eastbound on River Road, saw Kruszewski’s lighted bike and safely passed her. Then he heard a loud crash and saw in his rearview mirror a vehicle quickly approaching him and tailgating him, he said.

Click on va; you get the sad extent of our cell phone laws. I've been in the legislature when they debate this in commitee; it always dies there. According to our politicos, this is a personal responsibility issue that does not need to be legislated.
One of the things about the last couple of days is the extent to which Mr. Webb is a tool, the latest being the golf club/windshield excuse. As an RVA cyclist, this has been painful to watch.

A similar case happened here.
The guy had been up all night drinking and drove home in the early AM. According to him he dozed off and when he woke up he had a smashed windshield and was somehow still driving into his garage where he stored his bloody smashed up van until he heard the news and turned himself in.
He hit 5 people who were riding in a single file group.
"He also said he thought he had hit a post and did not stop at the scene because he had not realized he hit people."

This guy is a fool for driving in that state. Luckily nobody was killed. Two years seems fair.

Prosecutor must not have offered Webb any deal. Stranger things have happened, but I'll be shocked if he gets acquitted, and he would have been a fool to reject any deal that gave him any leniency, given the evidence against him.

Also if he gets only 3 years for this...he will go to a low level prison and get out in 9 to 12 months...then be on parole. I wish this dudes family did not have money....because that is what saved his a$$.
