85% of your worries were answered with the fact that the police ticketed the driver ....Now I have been hit a few times over the years and all I can recommend

if you were on a state route call it the state route not the street name ( Rte 42 VS pearl road etc) since state laws trump local laws

get 3 estimates from shops that carry your brand of bike (don't get your estimate from Bills bike and steak shop)

I hope you are not hurt but the drivers insurance covers you for all your bills and time off

DONT SIGN ANYTHING TILL YOU ARE COMPLETELY BETTER

* this is just my advice due to my past experience's * I am sure all the bike lawyers will follow now
