An Illinois senate subcommittee recently rejected a piece of legislation known as the "Boub Bill" that would have established bicyclists on Illinois roads to be both intended and permitted users of those roads. This is not welcome news for Illinois bicyclists, and if you can count yourself in that group, check out http://www.chibikefed.org/ for some things that you can do to help revive the bill.
Put simply, and as I understand it, after Boub v. Township of Wayne, 702 N.E.2d 535, an Illinois Supreme Court, decision a bicyclist cannot recover from a municipality if he/she is injured in a part of the street that is not clearly designated for bicycle use (i.e., a bike lane) because without such designation he/she is only a permitted and not an intended user of the road, and municipalities are immune unless the plaintiff is both an intended and permitted user.
I'm not looking to start a debate; this is just some information that I thought to pass on, particuarly for those in Illinois.
