ok so my bike has a bad habbit of trying to shift into the top gears when in a low gear, I thought it could be my derailer or maybe I need a new chain.......

Your derailleur might be out of whack, probable needs adjusting.

This problem is most often due to shift cable stretch or otherwise misaligned rear derailleur. Try adjusting the cable tension at the rear derailleur barrel adjustor. See http://www.parktool.com for instructions. Or it could be a bent derailleur hanger.
