I didn't know bicycles were considered bicycles if they have an electric motor. At that point I thought they were considered motorized vehicles. I guess they are now.

Delaware has a similar law. I think the idea is that 1 horsepower is the equivalent of a strong (pro-level?) rider so it's really no worse than a bike without a motor. And since a decent amount of that power never reaches the wheels in addition to all the added weight the bike is still quite slow (20mph on a flat road).

CA law is clear...

39000. "Bicycle", for the purposes of this division, means any
device upon which a person may ride, which is propelled by human
power through a system of belts, chains, or gears having either two
or three wheels (one of which is at least 20 inches in diameter) or
having a frame size of at least 14 inches, or having four or more
wheels.

Montana law is the same. I think its up to a 50cc motor there
