Yes, "-and-run" should significantly increase the penalty for anyone who causes injury or death on the road. Otherwise, the unintended consequence of merely increasing vehicular manslaughter penalties is the incentive for the perpetrators to run.

ya it's the RUN part I have such a problem with, a death is bad enough but if the driver stayed and called for help maybe a life could have been spared. Most likely the driver was intoxicated and fled to avoid jail time. To allow someone to die to avoid jail seems on par with premeditated murder.

Notice the time the accident happened, 4:15 am. It could be the cyclist didn't have any sort of lights. It is also possible either or both the cyclist & the driver were intoxicated. Granted the driver should have left the scene but what were the other circumstances of the incident? As far as I can tell right now, the only thing the driver did wrong so far was leaving the scene.

The story is weak, doesn't say a thing. The guy rode a lot and liked to ride at night because it is quiet. He runs a skimboard/clothing company with some friends. I forget if the tv said if he had lights, but he was riding in the proper direction and to the right.

Obviously it's the drivers fault or he was DUI, for him to "hit and run". If it was an accident then he had no reason to run especially if the fault was the biker unless he had something to hide from the police.

So when a person "kills and run" then its obviously the fault of the driver period.

Just because it is 4am doesn't mean everybody is drunk. Some jobs let off at that time and some start at that time.
