Hello,

First, I'm new to the site, so pardon me for jumping in with this question (I cruised the FAQ first and didn't find what I'm looking for).

Now that's out of the way, I have an ethical dilemma and would like the advice and imput of other bikers.

I live in a large city. There's a bike around the corner from my apartment, it's a good brand of bike, but it's been sitting there for at least two months, untouched.

Although it's well-locked (two chains) to an iron fence with the seat removed, it's on a busy street. It's starting to rust and the tires are well to being flat. I've left notes on the bike saying "move this or else" with no response. I first noticed it at least two months ago, and by all indicatations, it has been moved at all.

I covet this bike and have been debating what to do. I called the cops a month ago and they were ambivalent. I've posted on other sites, and the general consensus is, if no one cares enough to move it after two months, than it should be considered abandoned.

So, what do y'all think? Is it wrong, unethical, and illegal for me to jack the lock and take this bike? Is it a crime if no one complains? What if I do my best to make sure to contact the owner, like leaving notes saying "I took your bike. Email me if you want it back", etc etc?

Your imput, please.

Yeah, but two months... starting to rust. Give it a good home. Would you turn away an stray puppy? You monsters!

Do a title only search for "abandoned", you will get a ton of threads that answer the question.

You never know what the other person is going through. About 20 years ago I left a crappy huffy chained up for 6 months and was glad it was there when I came back because it was my only transportation. For all you know the person who owns it went to take care of their sick mother in Florida and will come back next week hoping to see the bike there after attending a funeral and losing thier job. Likely, no. Possible, yes.

Do you use everything you own every two months??? If it is locked it belongs to someone, if it isn't yours it belongs to someone.. taking something that belongs to someone else is not right.

If I got a "move this or else" sign put on something I owned, I'd leave it there on purpose to spite you.

How about cutting the locks and moving it inside so it doesn't decay further and leave a note/ sign saying to contact you. If another four months goes by, I'd say it's your's.

Yeah, why let it rot? Then no one could use it. Then it was just be an annoying hunk of rust that's no good to anyone.

if you take something that dose not belong to you that is stealing. ok thats about it no need to elaborate
this thing belongs to some one else, i dont believe there is a statute of limitations so if he chooses to lock it up and leave it for ever its his. be it a nice road bike or a pos huffy or what ever.. you cannot justify busting a lock up there is no moral compass adjustment here. JMHO.. let her rust.. it was ment to be. stealing it will just get some bad KARMA..
