For 6 moths Bailey (my Welch Corgi) grabbed the mail from the mail slot in the front door and brought it over to me. Against the advice of multiple training videos telling you not to, a letter carrier stuck her fingers in on top of the mail. A small dog can only see the bottom view, it was an envelope. And it happens fast too so there is not much reaction time. He bit right through one of her fingers. This was months ago. Now the mail slot is screwed shut, impossible to open from the outside and there is a mailbox on the house. If I did not do that the post office would stop bringing the mail.
The dog loves people, if that woman had walked into the house and shoved her hand in his face they both would be very happy. You can't really get through a door without looking like a person, the dog does not bite people, he bites the mail. Now the insurance risk at my house is lower than anyone with a dog and a mail slot.

However today my homeowners insurance was cancelled due to "unacceptable risk, dog with a history of biting". Banks don't keep mortgages on homes that don't have insurance.

I think I will find the decision maker for this and bite his fingers off.:mad: :mad: :mad: :mad: :mad: :mad:

You should invite them over to your house and introduce Bailey in person. If they survive the vicious licking that will surely ensue, they might be more understanding.

Could you tell the insurance company that you've gotten rid of Bailey without actually doing it. I mean, none of their pencil-pushing reps has ever come over and met the dog, right?

Yeah, whatever the case, your dog bit through somebody's finger. That ain't cool. I have a dog too and know that if he ever bites someone on purpose or accident that there is going to be trouble. How did the insurance company find out about the bite? Did they have to settle with the mail carrier?

Im my state there is no law that will allow the post office to collect damages unless he was outside of an enclosed area or on the street. He was inside the house. My lawyer (a three bike owning, dog loving, super competitive lawer.) says the first bite is not a legal problem. But another bite could mean a comittee forms and makes a decision to label him vicious or not. Then the laws change and get stricter.
Three bites he can legally be put down. I read the laws myself they are on the internet.
Like an idiot, I called the insurance company before I knew the laws and other details. I thought it would help and that a lawsuit was coming.
I had a short conversation with a good insurance guy tonight but had to cut it short. It sounds like it might be a problem. I'm going to call him tomorrow.

Ahhhhhh. I get it. Not the best move in retrospect. Still since a claim hasn't been filed I would think he could just switch companies with no problems.

Yep. Should have kept my mouth shut. That may have been an expensive mistake. I may have to go into an assigned risk poll just like a bad driver would here in R.I. From what I know that is very expensive.
Don't know yet. Portis may be right. I hope to have an answer or a direction to go tomorrow. The small part of the conversation I had to cut short tonight with my insurance friend, did not seem like anything good was coming.




What insurance company?

So, if the PO does sue, then the date of the dog bite would be the official date of the event, and they were the insurance company at the time, so they are still legally responsible for any lawsuit. Canceling the policy isn't going to change things.

BTW, it's also likely that this conversation went into a database for the company. At one time, insurance companies were lobbying for a national database of all such conversations and claims. They were whining about insurance fraud, and stopping. Not sure what happened...probably got nixed like the data mining project the NSA had proposed on US citizens got nixed by Congress (that was sarcasm; there's recent evidence that the NSA probably got funded by Bush by funneling money illegally from elsewhere.)

I think Bailey took it as a possible intruder to your house and took appropriate action.
Mail carriers should know better not to stick there fingers in a mail slot.

yeah, why the hell was the mail dudes fingers in the slot anyway.....you put the mail in the slot...not your hands! Its ridiculous the **** people getaway with today, it is so wrong. Every ones out for themselves.....jerks.

Ugh. Insurance companies are pretty disgusting. They rank pretty high on the list of things making the world a less pleasant place to live.

Good luck getting it all resolved, 2MB.

Sadly, I'd attribute it more to all the frivolous lawsuits and people who think they've won the lottery once they get hurt, even if they caused the injury themselves.

Good luck with getting this resolved 2manybikes. Are you and Bailey coming out to the ride in Lancaster, PA in August? :)

The mailperson stuck their fingers through the slot against their better training. Dog bit fingers unwittingly. 'Nuff said.

Any decent lawyer should be able to sort that out.

Still, this is scary!
