Bicyclist killed on U.S. 550 was bank executive


James Warden's bicycle lays bent along U.S. 550 Sunday after being hit by a car.

A bicyclist hit and killed by a driver on U.S. 550 Sunday was a bank executive.

James Warden, 48, of Albuquerque was struck by a car while riding on the highway shoulder near Santa Ana Casino just before 2:00 p.m.

Warden was the executive vice president at First Community Bank. He had been with the company for close to two decades.

Deputies cited the driver, Edmond Marley, 69, of Oklahoma, for careless driving. They believe he fell asleep at the wheel and swerved into Warden.

It would have been merely careless driving if Mr Marley hadn't hit anyone. I say it looks like criminally negligent homicide. Why wasn't the appropriate charge brought?

Charges can always be upgraded once sufficient evidence has been gathered. While it seems obvious, what if it was later found that the driver had suffered a stroke at the time of the accident. Or that he was driving while taking medication that warns of possible side effects. Either of these could change the legality of the situation.

Let's hope that an appropriate sentence is served.

Looks like "careless driving" is not much of a penalty.

Well obviously if the cyclist had enough sense to fall asleep like the car driver, he too would have swerved and his life would have been spared. Duh. ;)
