Does anybody know if shooting a fish (in a lake) with a .40 pistol is illegal?

It may not be illegal, but it will sure piss off the fish.

Just how white trash rednecky are you, dude?
Unless the fish is at the surface of the water, there's almost a zero chance you'll hit him.
Didn't you see that Mythbusters episode?

If it is a sport fish - almost certainly unless you can prove it was attacking you I suppose. ;)
If it is a trash fish (like carp) it might be okay (you can use a bow for example in most states) but you might want to be careful. Get the angle wrong and that bullet can end up not going where you planned.

Yes.
I have a picture of me from this weekend, and I was just wondering if there would be a huge uproar of hatred due to the subject. I also am not a fan of hefty fines...

Posting pictures of an illegal activity is rarely a good idea. Neither is discussing. Regarding shooting fish, I hear that putting them in a barrel prior to shooting yields good results - you don't have to worry about missing as much I would assume.
Was that tested on Mythbusters? :D
Email the pic to RyanF and use your Jedi mind powers to make him post the pic and claim that it is of him.

Sound advise noted.
I killed other things this weekend, so I'll post other pics.

Dropeing the huke would work as well.

You caught the fish with a hook and line, then shot it. It then slipped from your hands back into the water right? ;)

Yes.... That is correct.... ;)
HE grenade? It'd be more fun to spam 10 flashes and just run in a grab them.

But that kind of behavior would get you vote kicked.
Just drop an HE and run.

Just use a cattle prod...I think you can jack the voltage way up, and use it to stun the fish. Then you just pick them up off the top of the water. Don't know how legal, but it won't make a big noise to attract anyone and the fish don't have big holes in them from a .40 or HE.

The HE won't put holes in anything.
It will just wake them up.

Unless they have been admin_slapped for nade spamming.
The .40 tore the fish in half and I recovered an almost perfectly mushroomed Hydroshok...

It's what was in my gun at the time. When we go into the woods, I have 25 HS at the ready in case I need to protect myself from (insert predator).

It probably is illegal just on grounds of the potential for a ricochet. Public endangerment FTW.
Not flaming you, but it's not really the best thought out idea. M80s are more effective for fishing anyways.

Water.....ever skipped stones? I used to skip .20 cal pellets off the water, hitting a Buoy out in the distance.

A .40 Hydroshok fired into water at a 30* angle won't skip. A FMJ from 3 inches off of the water at an almost parallel angle... Hell yeah. I used to do that (with a .40) in the backwoods. Could get 5 skips or so before it was on the other side of the small lake .

Probably not the best idea regardless of the legality of it. Get a spear, get a net, or get a hook. Fishing's supposed to be fun and relaxing, not involving gunfire. I've probably caught more fish swimming with a net or spear than with a rod and reel.

fun? relaxing? Took my boys fishing this weekend. They are three and six. What is fun about constantly untangling lines, taking fish off hooks, putting worns on hooks more times than I can remember, dodging errant casts, etc. I would rather have given them both single shot 410s and let them blast away at Nemo and his little friends.

I find the prospect of Nemo getting capped somewhat appealing.

The only reason the gun was involved was that I hadn't gotten the pole out yet. It was there, so I shot it.

If you lived in Vermont it would have been cool.
" Vermont is the only state where the shooting of game fish is legal. Now, the sport is an endangered species."
"To bag her personal best, a 9-pound northern pike, Tina Capsey used an SKS, the semiautomatic Soviet military rifle and precursor to the AK-47.``If you want big fish,'' said Capsey, 45, the owner of Fish Tales, a restaurant in Swanton, ``you need a big gun.''

Uhh, just want to caution you that there is a species of trout on the endangered species list in Montana...it would get you a 10k fine and at least a year in the pokie where you might get the pokie
I know we use a rifle to shoot halibut before getting them in the boat...but those have already been hooked.
Sometimes if you fire into the water the concussion will knock a fish out (done this myself with a 22)
