If I remember correctly the 3 person board has one member that was selected by Landis. If it needed a unanimous vote then anyone could skate by just selecting someone who would vote against conviction no matter what.
I don't know for sure about this hearing, but in most arbitrations, each side picks an arbitrator and then they mutually agree on a third

If this is the way it is run I guess there would never be a unanimous vote! Maybe an arbitration hearing should only include disinterested persons.
In any case the sport could have done without this incident, it's sad that it happened at all.

And who would pick the "disinterested parties"? If the agency picks them, they cannot be "disinterested." The same is true if the athlete were to pick. This isn't like a court proceeding where a judge can pick a referee or something. Because it is an administrative hearing before the very agency whose decision is being challenged, there is no way to get "disinterested parties."
I think the prcess for picking arbitrators is fair. Even the arbitrator who is picked by a given party is not necessarily going to rule in his favor.
