Just finished watching it. Awesome. I love how the defendant at the end says they are "baffled" and then states "make sure your dog is on a leash at all times"

Damn straight.

And a 5k bike? Sure plenty of people own an expensive bike. I commute on a 2K full carbon bike. Then again my commute is 32 miles each way and is basically from one rural location to another so my "commute" is essentially the same roads that the weekend warriors ride.

I had an encounter once where a dog made me go down. Dislocated my left pinkie. All the other fingers were pointing north and south, the pinkie east and west. Besides that, it scraped up my bar end pretty good, now a lasting memory. Anyway, I rode straight to a doctor's office where he pulled it back into joint and I never even considered going back to where the dog was. Not sure why. I guess I figured I should have been able to avoid it though I know it wasn't my fault. My expenses were minimal.

The only thing I would have changed... I would have actually liked her to have continued her "If I backed up and he ran into me" argument because she was about to stick her foot in her mouth up to the knee... I don't think she realized that the person backing up is virtually always at fault... :D

I liked how it would have only cost them $1,100 if they stepped up, but because they were idiots, it ended up costing them $3,000.

Edit: Imagine how much it would have cost the idiots in added premium cost, if the cyclist had filed a claim with their homeowners insurance, rather than going straight to small claims court.

I tend to agree.

I have a little "litmus test" I do every now and then to check the pulse of the general public. In public situations where conversations can freely flow, I ask about cyclists on the road and what people think. I keep it simple, I simply seed the conversation and watch the results. I don't let on that I am a cyclist, I just want to see what most people think about cyclists... then in the end I may or may not inject that I am a cyclist.

The conversations and discussion show that the attitude of most is that first they have no idea that cyclists have rights to the road, and that most simply want cyclists out of the way. Period. Issues regarding taxes come up from time to time too.

Try it. See what you find the general public thinks about cyclists.

I think her attitude was very telling. He was 30-40 miles from home on a bike. How dare he!!!!. There are 10 miles of bike paths. Why is he riding his bike in my neighborhood. By the way, I live right off the highway. No bikes on the highway. - quite a bit of exaggeration here. it looked more like a local road from the picture. It certainly wasn't an interstate highway. Why is the cyclist to assume blame for being where, in a non-cylist's opinion, he does not belong? Does he forfeit his civil rights because what he is doing what seems illogical? Does it excuse their being irresponsible with the way they handle their dog?

Some people still have their heads up their butts!!!!!!

I'm not sure about the "general public", but I'd say it's true of the majority of dog owners. Have you not heard that Gizmo is a precious gift from the heavens above, and should be bound by neither leash nor law? Some people love their pets so much that they sometimes will completely disregard others (like leaving dog **** on sidewalks, paths, etc) and, seemingly, even not care about their dogs injuring others.

I don't know about a majority but I know there's plenty of folks out there who figure it just isn't necessary for a cyclist to be on the highway. If cyclists need exercise, there's plenty of better places to do it, like bike paths or roads with no cars.

That's obviously what this lady was thinking.

I must say, the planitff played his cards well. He had all his info, he kept his answers straightforward, he didn't say anything when the others were being talked to.

The defendants weren't as bad as some on these shows, but they played the 'not all my fault' and 'bad similie' game. Real judges hate that, so TV judges go ballistic.

I remember back in the 80's a Judge Wapner case where a couple of college students hit a cyclist (it was a comparatively poor black man whose bike was $100) and acted stunned that they should be blamed for anything. Wapner wasn't a yeller but he was obviously annoyed with the students, whose attitude was basicly 'What's the big deal? We hit a poor black guy on a bike! There's loads more where he came from and what are they doing there in the first place?'.

The man had no injuries, but his bike was totalled. He didn't have a receipt for it, however, so Wapner awarded him only 80% of its value.

If there is one they're going to believe we should be there instead of the road. It's the "not my fault" excuse, has nothing to do with them actually thinking about it.
