I don't see why you couldn't use either since the frame has a full seat-tube. As far as which is better, I'd say for anything except XTR, it doesn't matter. For XTR, the FD-M952 top-swing is better because it has the differential plates.

Either should be fine. I'd get top swing if I eventually was thinking of transferring the derailleur onto a full-suspension bike in the future though since FS frames may not have the proper length of seat-tube to clamp to with a standard (bottom) swing. Admittedly, that's a stretched point of consideration. Whatever you do, make sure you get a derailleur with the correct pull direction. Looks like you need a top-pull.

His bike is top pull (you can clearly see it in the picture). Top pull is bottom swing, bottom pull is top swing.

i need a top pull i know that. i think ill use the top swing
I have a top pull/top swing on my Trek 7000, XTR M960. You can use both, but like khuon said, it doesn't really matter, as long as it's a top pull.
Also, the new gen XTRs are top and bottom pull compatible coz they have a reversing mechanism that allows top pull as well as bottom pull bikes to use the same derailleur.
i'd go with top swing. no particular reason, though.
