Thanks guys. I did get list price (mostly) so with my bargain hunting skills, I should do OK for the property loss. I'm recovering as well as can be expected and crossing my fingers for no long term effects.
The next phase is to recover all the medical costs for my health insurance and pain and suffering and loss of consortium, etc. I hope to see you all on a ride soon.

Remember not to sign anything "final" that would say that you will not go after anything later.

You never know what may develop years on down the road because of this.

I made that mistake many years ago and that is why today a lot of my back issues are now covered by my own medical coverage instead of the person that hit me.

I don't know if I remember this right, but isn't there a certain amount of time that you have to settle for damages and bodily injuries?

I believe there is a certain amount of time before you file for claims. And a certain amount of time before you seek help from a medical facility or doctor.

But with an injury (correct me if I'm wrong) there are things that can come up in the future because of said damage. That is why on the back of the settlement checks (or attached to them), it says that by signing this check (to cash it) means you are agreeing that this is the complete end to this and no further action will be taken upon your part.

A co-worker refused to take it and they re-negotiated her case when she got a lawyer. She now has lifetime treatments pertaining to her slip and fall. She landed on her shoulder and at first it seemed like things would be okay after a while of physical therapy. But later as time went on, it became so that she could not turn her head in the opposite direction of her injured shoulder. Till this day she has pain on that side of her neck when she picks up something heavy.

Here's the list of statue of limitations from theattorneystore.com for California:

"California

* Personal Injury: Two years
* Product Liability: Two years
* Professional Malpractice: Legal malpractice, one year from date of discovery, to a maximum of four years from the date of the wrongful act. Medical malpractice, three years from the date of the injury, or one year from the date the plaintiff discovers or reasonably should have discovered the injury, whichever occurs first. If the medical malpractice action is based upon the presence of a foreign object found inside the plaintiff’s body, the statute of limitations does not start to run until the plaintiff discovers, or should have discovered, the object. The periods of limitation for medical malpractice apply to minors six years of age and older.
* Injury to Personal Property: Three years
* Fraud: Three years
* Libel - Slander - Defamation: One year
* Contracts: Four years if written; two years if oral."

So one has two years to file for bodily injury and three for property damage. Can't find any mention of whether there's a time limitation for settling, just filing as you stated.
