hey, has anyone ever had to file a claim against the mta after being hit? I was hit from behind and have a police report and witnesses that verify that the driver was at fault, but lawyers are telling me that the mta denys claims 99% of the time. that is not right. anyone have any success filing a claim? thanks.

My very good friend is a trauma doc at Harbor/UCLA......when the patients complain about this and that
(after saving their life), he responds.....you have to be alive to be inconvenienced. But seriously you got hit by a bus and live to tell about it. We need more details.

You have a choice: if its only the bike that was damaged, take the MTA to small claims court. Search and send the summons to the head of the MTA.

If you have physical injuries hire a good attorney. The MTA has deep pockets and most likely pretty good insurance.

Sounds like Chicago's CTA (former name - I don't know what they are called these days). These outfits are self insured and have ruthless legal departments. Decades ago in college I got hit by a bus in Chicago in an ambiguous situation. CTA sued me. My brother the lawyer explained that CTA sues everybody to scare them off. If you sue them, they counter-sue and will fight like hell. Scares the low level claimants away.

hey,

i was taken to cedars with road minor injuries--road rash and bruised hip. i was x-rayed to make sure there were no broken bones, then treated and released. i will not need further treatment, but i will have the hospital bill.

this is what i keep hearing about mta. the thing is that i do not expect a huge pay out, i just want my expenses paid and a modest sum for pain and suffering. lawyers are telling me that the case is too small to take, so maybe i should just file the claim on my own and then get a lawyer if it is denied.
