Yes, that be the one. As to how it happened, I have no idea. It's up on Velospace, so I suppose they have a marketing intern trolling the sites in his/her spare time and found it. Very flattering! I hope they sponsor me to the tune of a pair of B66 or B73s and a set of Brick Lane roll-up panniers. *Hope hope*

Yeah, this seems pretty strange. I wouldn't be a dick about it, but you should send them an email saying, "Hey, I'm glad you think my bicycle is nice enough to represent your product, but you could have let me know you were going to use it! Also, free-stuff please."

I hope all of this "sue them" **** is sarcasm. It would have been polite for them to contact you, but honestly I'd feel pretty good if a bike company thought my bike was good enough to represent their company.

Not only that, but the hubris of thinking that a bike you assembled, with parts you bought and did not forge, and painted with colours you did not mix, is absurd to the maximum.


You can own the final assembly. The idea and image is public domain (unless you copyright the photo).

The idea and image is public domain (unless you copyright the photo).

Not that it matters, per se, but photographs are copyrighted as soon as they are created. Registering a copyright only gives you a more solid case in the event of a dispute.

Right, so we're sue happy and he shouldn't sue. That doesn't mean it is polite for brooks to use it without asking. If they want to sling him a free saddle as an apology, cool. If not, I think a bit less of them.

if you didn't click some release form when you posted that on velospace, then brooks is using your property without your permission.

write them up an invoice, (quickbooks to the rescue) and send them a bill due and payable upon receipt, make sure you send it 1st class, registered, and delivery notification.

they'll respond pretty fast, watch. ;)

THEN you mention that you could use a $500 honey/titanium saddle and matching panniers :D

oh and thats just an amazing looking bike, btw, I can understand why they wanted to use the pic, very nice work.

This is wrong. The photographer owns the copyright to a photo untill the specifically give up that right.

that said, there is no need to sue anyone. Simply contact Brooks and point out that there marketing intern probably needs to catch up on copyright law. In the mean time, you are proud and honored that they chose to use your picture of your bike... and they are welcome to continue to do so in exchange for a (insert the item you want.) There is nothing greedy or unethical about that. It is YOUR picture, not theirs.

Thanks to everyone for their input. I sent an email yesterday telling them I was the owner of the bike and the photgrapher. I made no demands for credit nor compensation as yet. I'll wait and see if they contact me and make any sort of good faith concession. If not, I like the invoice idea, thanks for the suggestion j0e bik3.

Thanks for the correction. It may not be unethical to constantly seek compensation and fame in our society, but it's not right.

We should have higher values, like the people in Star Trek.

I submitted the photo myself a long time ago and forgot. *insert bemused smiley* I still feel the wording of my email is appropriate, essentially I said "Thanks for picking the photo of my bike as your front page. Would you like to send me a pair of saddles for my almost finished tandem (http://velospace.org/files/Tandemwithbaskets.jpg)? It's screaming for a pair of heavy duties!!"

Brooks should've contacted you. Not all photographs are open source.

Which is not to say you should cause difficulties for them.
