The following came in my email today. The Boub v. Wayne legislation has been a hot issue for cyclists in Illinois for a long time. Legislation to correct the Boub decision has come before the Illinois legislature before, and has been defeated narrowly. Do what your conscience dictates.
We're asking our LIB-affiliated bike clubs to help us pass legislation very
important for on-road cycling in Illinois. For a long time, we've tried to
fix the impacts of the 1998 Boub v. Wayne court decision, including:
- Illinois bicyclists have no liability protection from road defects, as
other roadway users have and cyclists in other states have
- Towns that want to improve on-road bike safety through signage or bike
lanes incur liability, towns that do nothing get immunity
- We're the only state with this bizarre and powerful disincentive - some

Senate Bill 275 could come to a vote in the first week of November during
the "veto session". More details on the bill are at
www.bikelib.org/boubcase/sb275.htm We expect it to be extremely close, and
we need your help.
Please call your state representative and senator (find yours and their
numbers at www.biketraffic.org/boub_search.html), before November 2. (It's
OK to leave voicemail.) Mention that you're a bicyclist in their district.
Ask them to vote Yes on Senate Bill 275 in the veto session. We're hoping
to sway Reps. Sacia and Mitchell from their previous NO votes. And, please
let us know at ed@bikelib.org so we can tally the phone calls.
