i got hit by a honda of some sort today. the ******* hit my back wheel where i proceeded to face plant. luckily the ******* swerved around my skull instead of crushing it with his tire. my bike is ****ed. im ****ed. the best part is the guy yelled at me for riding my bike on the ride. i informed him that PA route 51 is a bike trail and pointed to a share the road sign. all sorts of cops and paramedics came. but im all good. just a little shook up, scraped and bruised.

so you gonna get some money out of the guy or what?
words of advice:
-insurance companies are trained to give you the lowest payout possible, and will use their lawyers to the fullest extent to accomplish this.
-consider a lawyer if the guy puts up a fight, or if you really want to make a buck. there's usually a cyclist rights contingency fee based guy around.
-settling out of court is smoother and breezy if you can negotiate matters with the driver. i managed to do this twice.

this is all assuming 1) you got the license as the guy drived away or 2) the guy was an actual human being, and stopped to trade info.

we traded info and are gonna make plans for him to pay for the bike parts he messed up(and some he didnt). i already called this ****** to ensure he didnt give me fake info.

Yeah make sure you clean the ******* out for everything he is worth and then some. Who cares if he is willing to make up for what he ****ed up, why don't you just tell him the bike was worth 20,000 so that he is really ****ed over, that will teach him.

Do the right thing, get your medical and broken **** fixed, suck it up and walk away.

If he yelled at you for being in the road, then **** him. Make him pay for your bike. Go to the doctor. Make sure everything is ok. Make him pay for that visit. Make sure you report this to his insurance company. That way, he will have to pay through the nose for years if he wants to continue driving (and he does).

I got clipped by a car in the middle of winter in 06 and now I have no feeling from about 5 inches above my thigh to the middle of my shin on my right leg. I totaled my frame out when it bent around my knee I didn't collect any money, I didn't even collect a plate number. You're lucky he stuck around to make sure you weren't dead.

Like I said before, you're not.

damn that sucks bro. i've been hit by car mirrors and thats it. sometimes when some dumb b@$tch on her cell cuts me off and i meet her at the light i would run my pedal along the bottom of her car. thats when i was all bmx and younger maybe i shouldn't have done it but its not like us riders would get respect here anyway

Go make another "conversions are gay" thread so you can find another niche to pidgeonhole yourself into before the rest of the trend catches up.

It isnt acceptable, but you dont clean someone out just because you can, the world is full of enough bs as is, be fair and move the **** on.

speaking of accidents....today, while waiting for the bus, i saw an old lady, probably about 55-60 years old, stumble out of a bus and fall on her ass. this happened like 10 feet from me. it was sooooooo funny. i just stood there like a statue and stared at her. i was like, "hmm...should I help her up? ummm...uhhh. *pause*...*another pause*". then finally, the next three people who walked by stopped to comfort her. they called an ambulance and called a cop over. the whole time i was just standing and staring. what's weird is i didn't feel at all bad about not helping her. am i evil?

i hope they start making so if you shoot someone on accident all you have to do is pay their medical bill and maybe buy them a new jacket. assault with a deadly weapon? what's that?

Typically if you do this sort of thing, the driver will probably opt to have his own party of choice do some damage appraisal to make sure you're not getting away with extortion.

I certainly hope so. I guess I apologize to the reactionists here on ssfg, I don't have the cool stance on the issue, but doing the right thing > trying to **** people over

Pfutz... it does sound like it was an accident. I also don't think the OP was whining... Im sure he was brandishing it as a badge of honor. Theres nothing wrong with that.

This is what I am saying. **** happens, ride your bike.

I doubt many of us on this forum pay attention to all traffic laws, if one of us hit a pedestrian and they extorted us for money we probably wouldn't be too keen on it, so instead of turning everything into a war people need to keep **** positive and focus on settling disputes fairly, its better for everyone.

I would keep your legal options open. If you didn't get an accident report, you should have. When this guy hears how much the damage actually is, I bet he bolts. He probably thinks a bike should cost $50 at Wal-Mart. I appreciate the impulse not to take it to a litigious place, but if you don't take some steps early you might be leaving yourself nowhere to go.

yep, i know of an instance. luckily, there were police reports filed. but when the driver found out he ruined a $1,500 build instead of the $250 he was expecting, he immediately refused to return calls. the cops got involved, followed by his insurance, all of which turned what was supposed to be a simple transaction into a month's worth of trouble for my friend.
good news was, the replacement build ended up being mostly upgrades.
bad news was, the old build was mostly vintage.

and getting back on topic, i'd say don't screw the dude. if perhaps you want to try and get a shop to price your parts as if they were new, whatevs. replacement costs. but trying to go from sugino rd's to grand mightys over this is....well, that's pushing ****.

I saw a guy with lots of grocery bags full of recycling trying to catch the bus. It was one of those articulating buses so when it stopped for him after he banged on the side, it lurched back pretty far as the back portion was still just barely away from the curb. I guess it scared him because he lept backward, tripped on the curb and had an impromptu yard sale of recyclables. He then cussed the bus driver out while he picked up his cans and the driver just patiently waited for him. Did I mention he was fat and there was a lot of skin when he fell? It was awesome.

I'm not at all anti-car, but you need to get proper medical attention and get your bike fixed. if you all think that 20k is a lot of money, have you been to the hospital lately? my wife (before we had insurance) got 2, count 'em 2 stitches for $1,000. Then we got the bill for the doctor separately for $850.

I got tagged from behind many years ago, hit and run. I got the license number, 10+ witnesses, and the state troopers who responded went to his house, he said that it wasn't him, case closed. Running down a 15 year old kid at 45 mph? no problem.
