I Just Had to Share This Amazing Story With You
This is the best summary of this unique disability legal case I have ever seen, and represents how the law can do good. I just found this well written story on the internet tonight.
"A 'David vs. Goliath' Story
This is a true David vs. Goliath story, the stuff of such films as A Civil Action, Erin Brockovitch and Philadelphia."
Tim Fox is my son, and Amy Robertson is my daughter-in-law. Kevin Williams and Carrie Lucas are good friends of mine. Enjoy.

Dnvr, this victory is even more far reaching than was mentioned in the
article. While no one in my immediate family is a chair user (yet), my
wife and I have had enough issues pushing the twins around in a rather
large stroller. Stores were always a major problem. So in my opinion all
Americans with Disabilities and all parents of strollered youngsters also
owe thanks to this brilliant team of lawyers.
Thanks for sharing.

This was the largest settlement of its type in Disability Law history.
Denver, thanks much for sharing. I knew your kids have had to deal with physical disabilities, but I did not know much else about Tim. Great story!

Wow! You have good reason to be proud!

Wow. What an amazing story. Congratulations to all involved. Wonder why K-Mart fought so hard? Seems a bone-head move.

It seems that these kind of advocacy efforts always get mired in the legal system and drag on forever. The same was true for the Right to Treatment and Right to Education efforts. Kudos to your family and friends for being tenacious enough to fight the battle.

It's a bonehad move if they lose. If they succeed in getting the plaintiffs to go away, they win and you never read about it anywhere, and it saves them money.
If you want a reason to dislike lawyers, the behavior of the Kmart lawyers provides a good reason. People complain about personal injury lawyers advertising on TV - the real Dark Side of the legal profession is the corporate lawyers who suck huge amounts of money from their clients solely to obstruct justice. Lawyers like that are the ones who give good lawyers a bad name. Lawyering like those folks did (which is only done at the direction of the corporation) is a good explanation why Kmart went bankrupt.
The ADA is one of the greatest pieces of civil right legislation ever. My only personal brush with it came when I had an ostomy as a result of my colon cancer surgery. ADA-compliant bathrooms are a godsend. The ADA is not hard to comply with in new construction; retrofitting old buildings is expensive.

Great article, thanks for posting it. I develop affordable housing for people with disabilities, so this is very interesting to me.

I wish I was savvy enough to illustrate a standing ovation here.
