most wrecks ARE accidents by the very definition.
the fact that they are accidents doesn't mean there's an absolution of responsibility :rolleyes:

I'd have to agree with commuterrun. Once the driver chose to pass on a blind corner they had to accept a wide range of possibilities that might occur. The mere fact that you are travelling down the wrong side of the road implies that you may encounter a vehicle coming the other way. The argument here is that this choice is not due to ignorance or calelessness but rather a willful neglance. The law deals with what a reasonable and prudent driver should have expected.

Would anyone choose to do something like that if they weren't ignorant of what could happen?

It was willful negligence. I'll contend that it was also done out of ignorance.

The point I'm trying to make is, nobody drives around looking to cause accidents. Unless they're trying to commit suicide or insurance fraud, nobody wrecks their car on purpose.

And, no, I don't "feel bad for her", or whatever bull**** that was said earlier. She did something stupid, and she needs to feel pain over it. Same with the California cop.

But the incident was the result of other factors -- bad parenting, bad training, etc. If those things don't get fixed, we're only counting the days until the next stupid, fatal wreck.

The latest information was that the teen was texting while driving and had 3 other teens in the vehicle. I doubt that she was paying much attention to the road.

Considering the definition of carelessness uses the word "negligent"....

Negligent~Careless~Accident.

People just trying to change the meaning of "accident" to fit what they think it should mean, kind of reminds me when little kids say "The word means ____ to me, so thats what it means!".
