Advocacy & Safety - ticket thrown out

A buddy of mine, who I sold my old bike to, recently had a collision with a car. The guy ran a stop sign, hit him then when the police showed up, sited my buddy for "failure to yield". I just happened to seee him one evening and he told the events that transpired. He was on the street and the guy wrecked into him. The cop never took his statement, I told him to fight it and he did. The prosecuter kept asking questions to the cop and kept answering his own questions. The judge informed the prosecuter that he couldn't do that. He asked him if he would like to dimiss the ticket. The answer was "yeah, that would probably be best". Now, my buddy is getting a lawyer to handle the civil side of this. Small victory:thumb: but still a victory:beer:

How do these COPS not know what basic traffic laws are? it's not rocket science. I think in tis case this cop isint there to be a public defender he wanted a badge and a gun and a really cool car.

They may like to THINK they are the law, but situations like this one prove them wrong...and I love it. They are fallible human beings, just like you & me. I'd do the same thing...sue the 'ace' off them for false charges, etc. -- these WOULD BE false charges, as an officer of the law is expected to KNOW the law, and there is NO law in the US of A that requires a cyclist to yield to traffic that has to stop for a stop sign! Same rights and responsibilities as drivers in cars in all 50 (with the standard exemptions that we all know about).

A friend of mine was hit BY a cop car in 1999. She was riding on a sidewalk downtown (a posted no-no) and failed to yield at a blind alley-way (doubleplus-ungood no-no) where the collision occurred. The cop gave her a ticket for riding on a sidewalk, failure to yield, and never sought medical attention for her injuries after she fell off her bike. She took the city to court for medical bills and to have the citations dropped. She was reimbursed the medical costs but the traffic violations still stood.

What's my point? Well, I don't know either. Maybe a small victory is better than nothing. Hopefully your buddy has good luck with the civil stuff!
