I do not know how long this link will stay open to MSNBC news but this is the result of an American Driver (possibly drunk) slamming into a road race across the boarder from Brownsville Texas. If he was drunk, I hope that they don't give him back.
The picture alone is just awful. :( Jaw dropping. WTF?

Five of the bicyclists were killed.
This photo shouldn't be on a major news web site. That is just not news. It's morbid.
Sooo many issues...
One possible illeagle alien.
2 drunk driving.. the fact that bicyels wehre involved is a coincidence this could have just as easily been a parade and or school bus.

Getting drunk drivers off the road is an excellent starting point for cycling advocacy. It should be more easy to sell this to JQ Public as there is something in it for all of us.

that goal would be far better than intentionally causing traffic jams, that's for sure. everyone would solidly and emphatically support removal of drunk drivers from the roadways. primo-comment.

Our society is too lenient on DUI charges. On a first offense, we should impound the car and suspend their license for 6 months. Plus a $1000 fine!

heck, i just heard of a teenager (clearly not old enough to legally drink alcohol) that got busted on a DUI and she was obviously not concerned by her actions or legal downside.
it's unbelievable what people will do without considering the consequences.

If that were to happen, the law would have to be more stringent on what actually constitutes a DUI.

One story said the driver was a team mate of some of the cyclists.

Driving with a BAC of .08 is not stringent enough?
And speaking of teen drivers... wasn't there just a story of a 17 year old that had just hit two more cyclists while Drunk... on a suspended license... and he had hit another cyclist just a year before...
Talk about lenient... I think that young man needs to spend some time drying out in a strict work camp somewhere to learn about being a contributer to society.

.08 is stringent, but it's also at the cops discretion, so if you blow .04 (a beer), but your drunk friend who you're driving home gets lippy with the cop, the cop can write you a ticket for DUI.

If by Illegal you mean the guy was an American Citizen in Mexico then yes.
and by drunk driving you mean driving drunk and blowing lines of cocaine off his dash board.
Whatever it is; illegal or not illegal, drunk or not drunk, it's still one idiot human killing cyclists.

soo one thing that bothers me about the picture is why didnt they swerve to avoid the car

Perhaps it was that no one looked behind while the car rapidly approached.

I think the term "accident" gets used way too often with regard to many of the thing that happen on the roads.
You (the generic "you") are a licensed driver. You've been tested and demonstrated you know the laws. You deliberately drank alcohol, then deliberately got in your car. Or you deliberately drove 20mph over the PSL. Or you deliberately ran that stop sign. And then you call what happened as a result an "accident"? Methinks there was nothing accidental about it. Maybe even pre-meditated.

The photo in the above link was cropped on the right side....I saw the same photo on a different site and it showed a black and white Mexican police car coming toward the camera that had swerved to his left to avoid the drunk driver. It would appears that the Police car was right in front of the pack, saw the oncoming car on the wrong side and swerved to avoid the accident, thus the cyclists' view of the oncoming car may have been blocked, you can see that several riders (perhaps the front of the pack?) did swerve off the road to the dirt (just behind the pole) avoided being hit. The back of the group didn't have time to react.
Drunk Driving and impaired driving (cocaine in this case) is not an accident, it is murder.

Additionally, by the looks of that picture, the pack was fairly tight. If that were the case, the riders in the center of it would not have really had the option to swerve. Sure, they could slow down, but if that guy's speeding towards you in the opposite direction, that's not going to be a very useful option either. Terrible tragedy. That picture is ridiculous.

That's silly.
First offense: License revoked for life. Plus a felony charge, and 5 years probation. No imprisonment.
Second offense: (Driving without a license, and a DUI)
* Within the probation period: Life imprisonment.
* After the probation period: 6 months in prison, and 10 years more probation.
Something along those lines. The key parts are these:
1. Never let these people drive again.
2. Make sure they won't want to with very steep penalties. You need this because it's unlikely you'll catch them driving drunk again; so the penalty must be steep.
Now, if you kill someone when driving drunk it should be a considered similar to second degree murder.
