I've done it several times. Never a problem. I suppose time of day is a factor to consider. Early is best. Many times I've done it without a single car passing. And it's a good idea to ride without any music so you can hear any oncoming traffic on certain bends. Most of the time you have plenty of warning from the sight or sound of an approaching car a good distance ahead of you.
As far as the legality - were I to ever be approached by a lawman while on Tuna, I'd just plead ignorance. I'm also respectful toward police and sheriffs, I live locally, and I'm a military vet, all of which helps to slow their urge to issue tickets.
Edit: Um, it's a very harsh ride on account of the steepness. There's a mile long section beginning at mile two that's at or above 20% grade. It's constant and punishing. I've only ridden up using a 30/26, or 34/30 combo. Anything less and I doubt I would make it up without stopping. The challenge for me has always been to make it through that worst section without stopping. Last time I went up was Superbowl Sunday, listening to the game via radio (one ear only). It was awesome.

Thanks for the response. Yeah I descended it last night around 5pm and didn't encounter one car. My hands are still sore from braking so hard... :) The other thing I'd point out is that the road quality is pretty poor throughout. There are a lot of cracks and bumps throughout.

You forgot to add a winking smiley after saying you "didn't encounter one car." Well of course you won't encounter another car, cuz you're going the same direction as they would be! ;) Perhaps even faster :twitchy:
Tuna is pretty harsh for descending, for sure. Of course, on the way up, you don't feel any bumps because you're only going maybe 5 mph :D
