The recent cyclist fatalities in the San Jose area have spooked me a bit and made me more observant of the cars. Anyway, I have been watching them and have noticed that quite a few drivers let their cars drift over the white fog/shoulder/bikelane line. Can't motorists keep their vehicles in their lane? They certainly complain whenever a cyclist moves into "their" space.

Has anyone ever heard of the police citing a motorist for failing to stay out of a bike lane?

The only time I'm aware of anyone being cited was when a guy hit me from behind because he was driving in the bike lane

I've noticed the same phenomenon around here, too. Especially in Surfers Paradise. It would be interesting to compare just how common this is across various locations. On my observations thus far, it is far more common in Queensland than in New South Wales, Victoria, South Australia or Tasmania.

The bike lane on on my commute is on a lond sweeping curved road. Cars are always drifting into it and and cutting through it going the other way. The police have radar traps set up there all the time. Because of the dangers presented by this bike lane I ride the sidewalk here and was stopped by the cops.(against the law here). When he asked why I was doing this right in front of him I explained to him that it was for the same reason he bwas there, too many crazy drivers doing 35 over the limit on a city street. He nodded and sent me on my merry way. I have seen (only once) a motorist get pulled over for driving in the bike lane. It was a rewarding experience to watch.

That is the main reason why I will not commute in the dark. At least during the day time, if I get hit by a car, there will probably be witnesses. In the dark, they could just drive off and no one would see anything!
