Foo - what would you do in this situation

this is copied and pasted from where i posted it in another forum, so it may sound a bit odd as i've condensed it.



so, my tub got resurfaced today. when the guy came i opened my living room windows (it's right next to my bedroom and my bathroom). i went back to my apartment around 11am and the fumes were so strong i couldn't get in the apartment without holding my breath. the were BAD! REALLY BAD. i can't stress that enough. so, i opened my bedroom window too. i went back at 4:30pm to check on it and it's still too bad to breath in the apartment. not as bad but still about 75% power. the smell is at a level around... my guestimate... 75 times worse than paint fumes. (it was 100 times worse!). i call the leasing office and they just give me the run around about it and tell me the fumes won't harm me.

is that true? i find that VERY hard to believe. now i'm worrying about the food i had out being ruined. even though most of it is in plastic bags still (the original packaging) i've had my dust masks ruined in that past even though they were in plastic bags that were fully sealed (i was trying to keep a dust mask in the locker i keep my paints and paint thinner/mineral spirits in. every time i open it it smells very strongly of chemicals).

should i worry? are the fumes dangerous?

i called my coach and i couldn't stay with him as i had no way to get there. i called the cops, they told me nothing can be done unless i get sick. so, i went in, got a bit dizzy, called them back. they came and told me they could smell it from the walk way (i'm on the third floor!), and that they couldn't do anything but tell me to call an ambulance and that's a bit much as i don't feel deathly sick and i don't have health insurance, but at least i have a witness to the smell.

what can be done about this? will this stuff have ruined any of my food?

so, now i get to sleep in the art building for the night.

If it was a fiberglass tub, those fumes are nasty. I wouldn't breathe them, but I don't think they would hurt food sealed in a package.

The landlord/lease agency is obligated to provide you with a safe apartment. Ask for a MSDS (Material Safety Data Sheet) for the stuff they used on the tub.

That resurfacing compound takes about 48 hours to dry and they haven't repainted it yet right? The apartment management should have provided you with temporary living quarters at their expense.

The right thing would be for them to provide a temprary place for you but since you asked what we would do. As Artifice says, I'd find a friend to go to for the night and let it go at that. If I had wished to take it further, I would have called the Tenant's Association office for my area. They usually provide limited or free legal advice to inform you of your rights. Maybe the apartment management can reimburse you or give a discount on this months rent for your troubles? Most city ordinances favor property owners and property management so you'd have seek your own legal counsel if you wish to go further with this.

I do Kitchen and Bath remodeling for a living, so let me give you a little in-site.

When I get to a job, I have two priorities.

anyway, i ended up sleeping on the art building floor that night. the tub is still emitting fumes. all the management has done so far is put a tornado fan in my apartment, and it's not so bad with the fan on, when i turn it off it gets quite bad. i tried leaving the door to the bathroom shut for a 4 hours or so while i was away and when i came back the smell was pretty strong (this was yesterday). i've been sleping in my living room.

they actually tried to blame the smell on my oil paintings and tried to say it wasn't that bad (artists oil paint emits hardly any smell. i'm using the windsor and newton series one paints). now i'm trying to get people to come over to smell it as witnesses (if you're in the richardson tx area please pm me so we can set up a time for you to come by. i'd appreciate it).

every time i speak to them about it all they do is lie. so, i am thinking of filing suit against them. is there any sort of housing authority in tx that deals with this sort of thing?

CbadRider is correct. They have to be able to present an MSDS for the chemicals they were using. If you ask for it and they can't produce it, then you'd have a better case for a formal complaint.

is there a way to hand this over to a criminal court of some sort or something in which i wouldn't have to hire a lawyer?
