Cyclocross - How large a tire can a Phantom Cross Pro take?

To all you Fantom Cross Pro owners out there, what do you feel is the largest tire that you would feel comfortable putting on that bike without fenders? And for those of you that have done some loaded touring, do you think you could load this frame up with 40 lbs of gear, balanced between front and rear panniers without the frame getting squirrely at higher speeds? The rider weighs in at less than 175 lbs. As always, thank you for your input.

On my 2006 fantom cross which I think is the same frame though I may be wrong. 38 on the rear end leaves about a 1/4 inch of space on either side of the tire the front end has a bit more space can't remeber off the top of my head. And have easily carried 50+ lbs of groceries with a clamp on rack and for the record I am 175 also.

I've fit a 42mm Mythos CX Slick on the back (though it measures closer to 39mm), and a Mutanoraptor 44 up front, with reasonable clearance for dry conditions. The limiting factor becomes toe overlap.
