If this is how investigative journalism is allowed to do things then maybe they should be stopped. I'm not sure how this can not be seen as defamation of character in the eyes of the court. I'm sure this is not the end of this story.

Hmmmmmm.... an American trying to sue a French Publisher in a French court. Talk about fighting an uphill battle. I wonder if they plan to distribute this book on U.S. soil?

So, in france if someone brings a case to court (and lose) they
get hit with an abuse of the legal system? hey they should start
that over here, might cut down the amount of frivolous law suits.
That said, remember it was the French Legal system who was investigating
him for how many years (and they are still not fully convinced he's innocent)?

Why does this news not surprize me?

You are right about the US taking a queue from the French legal system! Did you also notice that he had to pay the legal fee for the defendent? That's right, looser pays the legal fee! We need that tweak to our legal system over here in the US!!! Maybe, just maybe, it would slow down some of these scum-bag law suits that clutter our legal system.
