Mountain Biking - Did I get ripped off on eBay?

On the 4th of August, I won the auction for a set of lightly used Sram X5 trigger shifters and an X5 RD. I wanted to upgrade the awful SX4 triggers on my bike, and also make the jump to 9 speed. The auction finished at only $21.50 with $10 shipping, which I thought was a good deal.
I wait a week and the package arrives. It's a paper envelope, sealed. When I opened it, there was only the derailleur inside, no shifters. I ask the seller if perhaps there was a second package as there were no shifters in the first one. He says "There was only one package. All items were contained (both shifters and the derailleur). Was the package tampered with?". That seemed like a funny question to me, and not one I would've thought of straight away. I looked at the envelope again, and noticed a tear in one end that had been taped over with clear tape. I didn't notice it before, and the repair was quite good. However, I didn't think that some UPS employee would jeopardize their career to steal a set of used bike parts out of a package, and then tape it up like no one would notice. So I asked for a full refund, and told him to include an extra $4 to cover shipping of his derailleur back to him. He refuses on the basis that he had written "No returns, no refunds" on his listing. I argued that that wasn't a valid excuse for not shipping me the correct item. IMO, the envelope I got was sealed, and didn't contain the item described, so he is liable.
Do you think he's full of crap? He didn't have anything bad in his feedback. Tell me what you think...

Contact EBay and PayPal if you used them. Other than that I think you've got very hope of getting your money back. I don't know if he's dishonest or not but he should try to make things right.

no other reason for him to ask you if the package was tampered with...
and if you were going to open a package... wouldn't you take the DR that goes with the shifters?

I've launched a claim with Paypal. My contention is that he didn't provide the thing he described in the listing, and the packaged I received was sealed. He has accused me of trying to defraud him, but all I want is my money back.

Anyone stupid enough to pack bike parts like derailleurs and shifters in merely a paper envelope for shipment :rolleyes:...next time inspect the package and if it's been opened and resealed don't accept it (I know you didn't notice this time, but nonetheless you have been recorded as accepting the shipment). Possibly parts just fell out enroute and UPS taped up the remainder, or possibly someone at UPS helped themselves...bad packaging and receiving practices can yield issues for sure...
Try a claim in any case, probably be refused for improper packaging by UPS. Shipper has an obligation to deliver what he sold, though. Did you have any particular agreement for shipping/packaging/insurance?

I didn't have any insurance, mainly because he didn't offer it. From UPS's website "if a package is not delivered, UPS can help by performing a search to locate your package. If the package cannot be found, the shipper can file a claim up to the declared value of the package contents". Notice it says that the SHIPPER can file a claim, not me.

He made the shipment and paid for it, that's why he can make the claim. Had you arranged shipment with UPS, that would be different. Shipper doesn't have to offer insurance, but you could make it a condition of the deal...caveat emptor.

Lol. Totally doesn't apply if what's received doesn't match the description. He's effectively saying he could have shipped an empty box and "no returns, no refunds" would have applied.
