Yeah I have no idea who comes up with these things... it almost trivializes the whole thing, like it's some kind of class room punishment.

" the penalty can be as light as a fine." plus restitution required after a civil law suit which the newspaper of record fails to mention or even discuss.
"Studies show" - Wow very old school of the NY Times, someday they will include links to the studies. Maybe Internet 7.0 in 2065.

It's about damn time, now if they would add talking on a cell phone while driving. A person who is texting and driving isn't that hard to spot as their driving habits are very similar to someone driving drunk, i.e. weaving all over the bloody road. One of the local TV stations did a story on texting and driving not too long ago. And they interviewed a cop who while following a pickup thought he had a drunk driver, but the guy was texting while driving.
The article mentioned that it basically "boils" down to the cops word against the drivers, and that the driver can always claim to have "just" been dialing the phone. But IF a driver is weaving all over the road for 5 or more minutes it's a safe bet that unless s/he is dialing multiple numbers that they're not "just" dialing a phone number.
