I don't get it. The minivan driver isn't eligible 'cause he didn't die *and* he already reproduced. The biker didn't die either or appear to have his reproductive potential curtailed.

Wait for this d-bag to file a counter-claim for his hospital bills, time lost from work, mental anguish, etc. because the cyclist decked him after the initial attack. You know it's gonna happen. There's probably a mile long line of lawyers with papers already drawn up, clamoring for his attention.

I severely doubt that. No lawyer in his right mind would take that client on a contingency basis.

On the other hand if the dude wants to pay hourly, well, it's his money.

Yeah, whatever lawyer he gets is going to be his defense lawyer. Now, of course, the defense lawyer will recommend a counter suit. However, said lawyer is going to be paid hourly.
