Hi all,

I was smacked by an MBTA maintenance truck in Cambridge, MA last night coming home from work. I was totally in the right, all their fault. This guy did not see me turned left into my path and whammo! A seperated shoulder and destroyed the front end of my Merckx. Any recomendations for next steps? I have a police report and am filing a claim with the T. I am a bit weary of dealing with a public entitiy like the "T". I feel like it will be a long time 'till I see a dime for the damages to my bike. Should I get a lawyer?

Thanks,
MB

Hire a lawyer. A smart, mean, nasty, hungry and honest lawyer. I know they are out there because I am married to one.

Start with the venerable firm of Dewey Chetham and Howe....

While I have never had to take on the local transit system, I did take on the county's DOT. I didn't do it with a lawyer, I did it with my digital camera.

Now, Noting the details you provided, you need to push the MBTA to reimburse you. Don't let it drop.

I don't mean, to go into the MBTA an threaten them. I mean, with the proof you have, you shouldn't need a lawyer.

Lawyer up!

Sometimes you can handle accidents by yourself. Not in this situation. Get a lawyer. Shop around a little, find one that handles bike accidents.

You will need a new bike too.
