Old news but I want to post a rant about this "recall". Have a set of these that failed after 100 miles. Get in the Q for the replacements. Anyway that was in June or July or something. Get an email that the product is delayed until Sept. Then delayed until November. Guess what November is gone.
The word is that the tires will nor be shipped until January, 2010. What the #@!$, is this the way to treat your customers? At this point who knows if the tires will be replaced or not.
If Schwalbe does not deliver on the replacements is there any recourse? Apparently the US govt. can make someone pull a product off the market with no real rules on replacing the item. All I know at this point is someone has my $$ and Schwalbe has handled this poorly.

This would be a warranty issue under the uniform commercial code. The usual remedies exist. Sometimes contacting your consumer protection agency can help.
I can make up legitimate reasons for delay, but they seem a bit hollow. The delayed shipping date appears a bit far out there.
The entity you bought the tires from is really in the middle, but might be another route.
I would file a polite and thorough complaint with my consumer protection agency. Point to the published warranty http://schwalbetires.com/company/warranty_policy and ask the agency to follow up.
I suspect they had to thoroughly investigate what led to the problems, redesign production for those tires, and then get the tires made. I could see that taking 2 or 3 months, including shipping. The issue is getting a bit long in the tooth at this point!

Kojak (the Schwalbe PR guy) hangs around on this site fairly often (I usually see him in Commuter). May be he can help?

Do you know WHY the product was delayed? For all you know they are doing more testing to make sure the same thing doesnt happen again, and you are safe while riding their product. If that is the case, then that is a good way to treat your customers.

Months of delays is not a good way to treat customers, if they don't have replacements then they should buy comparable replacements from another source. Not required but it is good business.

I guess I could post a snide remark that they are spending all this time looking for a plant in Vietnam to replace the one in Indonesia where the recalled "German" tires were made.
The retailer where the tires were purchased is as frustrated as I am about the time delay issue. And I agree with the statements about safety with the replacement products but the issue for me is do not promise a replacement date of September and not deliver in October, November, December, January, who knows.
The recalled tires were the top of the line and cost top of the line money.

That means the factory in Indonesia shipped them to Germany, the company in Germany then shipped them directly to you, rather then through the US distributor.

Funny how they market the product being made in "Germany" to give the illusion that is made with German hands. If everyone believed it was made in Asia, the product appears cheaply made with third world labor being exploited. Now we know the truth. Sad.
