The Civilian Complaint Review Board (CCRB) CCRB reopened the case when an audio of Sgt. Horohoe's previous statement regarding the incident did not correspond to recent footage of the incident found on a (You Tube Video).
Sgt. Horohoe testified before the CCRB that Vazquez rode into him. However the YouTube video clearly shows Sgt. Horohoe pushing Vazquez off his bike.

"This validates our concerns over the years that the NYPD is wrongfully harassing cyclists, especially cyclists that choose to ride in groups," Barbara Ross from Times Up said. "We believe cyclist group rides are constitutionally protected if all the rules of the road are being followed."

More than that, Ross sees this case as a victory for cyclists rights.

Critical Mass is often Bad News(tm) for both sides. Not to excuse the cop - perjury is inexcusable - but 'Bikers Gone Wild' never generates public sympathy for cyclists. The non-cycling public is, at best, indifferent to CM's antics. Fining NYPD $98 was a slap in the cyclist's face.

Kinda looks like the guy was running a red light. Hard to tell with the camera jumping around.

On the other hand, not cool to push someone down for running a red light either.

Even if a cyclist runs a light a cop has no right to push him off the bike. What the cop did was illegal and he knew it, and he was a lying SOB on top of that. I find it really hard to respect NYPD recently. NYPD is full of ******** that enjoy their powertrips: parking in bike and bus lines or corners of busy intersections, running red lights without emergency lights on, total disregard for public convenience and safety are seen daily on NYC streets.
