Nowhere in the US are you required to wear a helmet over the age of 18(or younger).

I think it's pretty funny and I like how both parties knew they were mouth-breathing, and it was resolved so quickly and easily. Wish more minor accidents/conflicts went that way. I think the cyclist didn't have a chance to brake b/c his right hand was busy messing with his camera cord or ipod or something.

It appeares that the cyclist steered INTO the pedestrian. Had he simply continued in his path, or steered to the right, he might have missed him. The pedestrian appears from the right, crosses the path of the cyclist, and the cyclist reacts late and steers LEFT to make the connection.
