The latter is the least bad, but the best would be neither.

The best law is one that assigns the cyclist the same right to the full marked lane as any other driver of a vehicle, but allows drivers of narrow vehicles to share the lane on a voluntary basis as a courtesy when the narrow vehicle driver deems this safe and appropriate.
