Just got T-Boned crossing a cross walk/entrance to my apartments. I flew onto the hood and messed her car up quite a bit. I fell down and my bike took quite the fall too. I thankfully didnt get too hurt, just scrapes on my hands. I got her info, name and number. I'm wondering what I do about my bike, how do I know if theres something wrong with it now? Should I take it to a LBs and make them check it out and see if anything is wrong with it? The lady said she claims full responsibility, she wanted to call the police and ambulance but I objected. I told her I just want my bike checked out and if there was anything wrong I'd give her a call.

****! Glad you're okay though.

I am not sure if you should get the insurance people involved but take the bike to a bike shop you trust and ask them to inspect the bike for you. Ask them for a quote for the repairs.

Oh yea, it's best to go to a doctor to get a check up.

I had a guy hit me once.
I went to police station to fill out a report.

The SGT asked, Do you want to know something?
I said Yes.

He said you are His 5 TH accident in Three Months.

You should have let her.

+1. There's a big difference between having a cop fill out a report at the scene and going down to the station a day or two after it happened to tell your side of the story.

When someone hits you with a multi-ton vehicle, you ALWAYS try to get a police report. No exceptions. At the very least, you get names and addresses of the driver and witnesses, pictures of the damage and scene, and all info - including calling their insurance company after the police.

Always find the humor in the situation.

But seriously, glad you are ok. My Buddy got T-Boned not to long ago and a similar situation happened. Except, the guy wo hit him took him to the hospital in his car and got in ANOTHER accident on the way there!

Glad you are ok again. Could have been alot worse.

glad to hear that you are ok!!! also good big she was cool and understands she could be accountable for the accident!

just wondering... isnt it almost always advised to get a police report at the scene? I mean just in case a injury does come into the picture? or if the bike damage is more significant once inspected?

File a report ASAP. Her insurance company could even come back and ask you to pay for the damages and you got nothing to back your side of the story. Insurance companies can be brutal in these situations. Insurance adjusters are crooked!!! They don't want to pay for damages so they will come after you. If no police report has been filed, they'll blame you for the damages.

Don't trust the women if she says that she'll pay for everything blah. blah. blah. File a report and hire an attorney.

and don't ask me how I know about this :notamused:

Man, you should have had the cops come. But just make sure you're not too messed up. Things like neck/spine injuries can take a while to manifest... I would have totally gotten the cops involved from the start. But do what you can now.

good to hear your ok it is unclear from you statement whether or not you were riding your bike or walking it depending on local law you may actually be at fault some states and cities prohibit you fom riding on sidewalks and in crosswalks unless designated as multi user paths look into this before you make any noise with the authorities as you could end up owing the motorist money

sorry to say it but it has happened to me a few times so....

they will have a sign stating that it is usable for bicycles ca law is you ride in the road unless otherwise marked
look it up on google there are examples of signage they are more common on the east coast and in foreign countries they are all over the place here in Korea

Since it happened at the entrance of my apt complex, right after the crash I went home.. I got the ladys info and stuff to give her a call about my bike. When I got home I looked in the mirror and my ribs had an abrasion on them. My right wrist had a pretty gnarly gash. I decided I should go to the ER so I was driven there. Spent the night and got some X-Rays. Pretty much everything is fine except some ligaments in my knee. Wish I could say the same for my bike. The wheelset is thrashed. Its like oval. Now here is the ****ty part. I filled out a crash form and stuff. The lady that hit me isnt answering her phone calls. I found her on FB and sent her a politte message asking her if everything was okay and that she wasnt answering her calls. She deleted her FB. I'm out of luck. I'm stuck with these hospital bills and a broken bike. This was my first accident ever. Now I know to call the police right then. This sucks. I know her car, adress, old number, first and last name but I have no rights. :notamused:

That being the case, call her insurance company RIGHT NOW. If she's avoiding you, she's probably also going to tell her insurance company a load of bull. Save every receipt for hospital bills, medication, etc. The insurance company is going to ask for a police report. Tell them after you get off the phone that you'll be filing one, and you'll get it back to them since you now have an insurance case number.

It sucks that the system penalizes you for trying to be a nice, honest person. You didn't think you were injured, and you knew that calling police / insurance would **** up the ladies life by a non-negligible amount.

But now she's reneging on her promise to help you, and promises don't count for **** in court.

I hope you at least have a couple witnesses backing your side of the story, so she doesn't try to claim you ran a red light and make you pay for her car.

It might be a little late now, but discussing pending legal matters on public internet forums is usually a bad idea.

If this goes to court her lawyer is going to love finding this thread and seeing in post #1 how you told her not to call the police.

Possibly. On the other hand, making a statement like that doesn't absolve her of the responsibility of making the OP whole. People who get hit by cars are not known for thinking straight, either, and that should be taken into account.

dsh
01-24-11, 02:30 PM
There's no "on the other hand". The comments made don't necessarily absolve the lady of responsibility, but absolutely nothing in this thread can HELP the OP's case. The best possible case is that they make no impact at all.

Things like the OP talking her out of calling the police, and the recent "this fat b*tch is gonna pay" comments can only hurt if they make their way to a judge.

I am going through a similar situation right now. However, the police & ambulance did show up and the woman who hit me admitted responsibility. And now, even with the police report acknowledging her failure to yield, I am still struggling with the insurance company. I may get some assistance.

I am glad to hear you are feeling better. I would encourage you to start a diary of the events and your daily recovery.

Maybe you should consult an attorney? Insurance companies are run my meanies.

My worse fear just got realized. People can really suck sometimes. Some folks don't take personal responsibility for their actions. I hope you get a good attorney and things work out for you in the end. Did you file a police report yet?

yea to add my 2c you always call the police and always do see a doc... I know too many people who didnt think they were hurt and then a day or two latter it creeps on on them... adrenalin has a funny way of making you not hurt... and as you have seen, people suck and lie...

Obvious troll is obvious, but on a certain level I agree that we should try to avoid getting authorities involves if and only if the person responsible is going to act responsibly.

Unfortunately, society penalizes this kind of forgiving nature (by making it harder to collect damages the longer you wait), so you've always gotta make a choice: give the person at fault a chance, or throw the book at them asap.

Say that she was drunk and you were afraid that she was going to try to run you down again if you called the cops....cuz that is what she is going to say about you, or something equally dishonest. I am sure your lawyer knows this and will be prepared for the onslaught of lies from her, she is obviously the type to lie.

I hope that everyone reading this thread now knows what to do in these situations, sucks that it happened to you OP, people suck.

Right, because the way to take the moral high ground is to lie through your teeth.

It's far more likely that the driver is simply scared. Probably because it's going to cost her money in the form of increased insurance premiums, plus whatever personal liability is going to be involved. People do incredibly dumb things when they're scared.

But you don't get past that by turning around and lying yourself. Tell the truth.

Ideally, this never becomes a police matter at all, beyond getting a report. It should be *entirely* between the OP and the driver's insurance company unless criminal behavior - i.e. hit and run, drunk driving, etc - is involved. After dealing with this sort of thing several times, I've always been made whole again in a reasonable time.
