Thank god for the witnesses. Otherwise there'd still be a pick up truck somewhere out there with a dent in the hood. Perhaps there's still some good left in this world.

I cringe when hear stories like this. I ride everywhere with my 10yo daughter. I insist that she rides in front and to the right of me. Hopefully if anyone gets hit it will be me. Just a horrible story for sure. Keep those kids in front and between you and the curb.

Another negative thing about this is that this will register as a cyclist death and, in the future, without the circumstances being looked into (like it's a drunk driving problem), be used as an argument that cycling (and not the real cause - drunk driving) is dangerous.

Yeah you might think, seems to me if you use a car to commit mayhem you can get away with it with a much lesser charge (unless there is evidence that you repeatedly ran over the person). I predict that if they ever succeed in taking away guns, cars will become the murder weapon of choice in the U.S..

They need to raise the penalty for drinking and driving, especially if someone is killed. Like I mean to insane levels where no one would dare even try drinking a fraction of a ml and driving.

in corvallis, oregon were i live a few months ago a girl that my brother went to school with was hit and killed by a car and they still haven't found the driver. they just left her there to die in the ditch.

Give them time to review the circumstances. In California, certain drunk driving deaths can be charged as second degree murder.
Not a good story for us parents in here... :P I have a 4 year old son and this just brings a tear to my eye and makes me hug him tight.

My heart goes out to you olias. I have a 7 yo daughter and 5 yo son. I can vaguely imagine what you feel right now. I'm so sorry. I haven't cried in years....

Very sorry that you son was lost. That 5 years is added on to whatever sentence the guy gets? I hope they add up the maximum sentences for all the charges and make him serve them consecutively.

My wife and I just brought our 4 year old Grand Daughter a bike for Christmas. While it will be many years before she rides in the street, it makes me think that even on the sidewalk she still may not be safe with idiots like this.
They should allow the parents of the child to inflict the punishment.

My son lived eight years and 107 days. In all likelihood, the man will do less time than that.

I hope that when this case comes to trial you will be allowed to make a victim impact statement, including photos of your son. Even if he gets life, it will do little to ease your pain. I hope your friends and family can help with that, and you have all of our sympathy.

I am so angry right now, I am so sorry. I run an afterschool program and work as a camp counselor in the summers and have devoted my life to working with children and to hear something like this boils my blood.
You have my symphathy Olias, I feel part of your pain.

its not much consolation but in the UK the system is even more screwed up and I wouldnt be suprised if such a driver would not do any jail time or maybe get 6 months in really bad cases. The only way such a driver would get anything like 5 years is if he said "yes i did it on purpose officer".
I have got kids and this is every parents worst fear.

Do Not blame yourself as I have a 15 year daughter and whether she is in front or behind me there is always some motorist that jeopardizes our safety on each outing.

A terrible, terrible loss.
When I was a kid, fifty years ago, riding a bike in a residential area was very safe. Drivers understood that their FIRST priority was the safety of children in the neighborhood. Today, many drivers seem to not give the slightest thought to the children in their community.
I have an eight year old friend I ride bikes with. We can't ride on his street. Although the speed limit is 30 mph, some drivers use his street as a "short-cut" between nearby four lane major streets. Cars come past his home at speeds of 40 mph and sometimes closer to 50 mph. Sometimes on the wrong side of the road. Sometimes chatting on their cellphones or leaning over to adjust the radio or put in a new CD. Drunk drivers are a danger to children. Sadly, children are also endangered by "sober" people whose driving reflects a "ME FIRST" mentality.

He also almost hit a woman who was out walking, after he already hit the little boy. He drove by my neighborhood trying to get to his own house. What a cold-blooded person. He needs to be locked up and the key thrown away (or far worse) He had his own kids in his truck with him when all happened, unbelted, imagine the nightmares they must have.

This accident occured at 1:30 PM in the afternoon. This driver was already dead drunk. I usually ride in the early morning and from the behavior of many drivers, I often wonder how many of them have had JAck Danials for breakfast.

Gardner- Yeah, I live in a college town and I'm a morning person so I love to get up and ride. I'm sure more than a few are still drunk from the night before around 6 or 7am. I just can't believe how people act sometimes.

This makes me so mad that someone could do something like this. Makes me want to move to another planet and never return. If I could I would. If ET asked me to go with them without a doubt I would say yes.
So angry that another human being could do this to a child and then a second time almost killing a women.
I hate this world. Thankfully most people are not like this but taking human life is uncalled for. No excuses. Life in prison. I don't care if your 1 years old or 100 years old +

That sucks. I feel for you Olias. There's some f'ed up stuff going on in Rocklin these days.
My son was hit by a truck (1997) while riding his little red bike when he was seven. Danny was just knocked out. Thank God.
He had a broken ankle and a broken femer(sp?) And his bike helmet was crushed. It was his helmet that saved his life the Doctors said. He always wore his helmet even without being told to. Three months in the body cast and hundreds of dollars spent on video games today he's ok.
We were lucky because the guy who hit Danny was a decent driver. So many times cars would speed down that street and I shudder to think if a hot rodder would have hit him instead.

the death penalty should be used in a second strike and your out law for drunk driving.
that means even if it's just a pull over.
