Bikeforums.net is a forum about nothing but bikes. Our community can help you find information about hard-to-find and localized information like bicycle tours, specialties like where in your area to have your recumbent bike serviced, or what are the best bicycle tires and seats for the activities you use your bike for.

This will be a fun one to see the result of.

One of the main movers behind the local cycling advocate (Hong Kong Cycling Alliance (http://hkcyclingalliance.org/)) was hit from behind while waiting at the traffic lights. The driver just so happened to be a retired Assistant Commissioner of Police.

The cyclist was charged with careless cycling and failure to have a bell (http://newsinfo.inquirer.net/210169/hong-kong-cyclist-hit-by-ex-cop-faces-trial-–-report).

Something smells fishy...

Court case due to start today - will keep you updated.

Throw a man on a horse, and he becomes arrogant of pedestrians.
Throw a man in a car, and... well you get the idea.

I think the LEO's 'attic', had a bright red 'VACANCY' sign out, to come up with those charges. I wonder what they will come up with next.

There is cursing so turn the volume down or don't watch were it would be frowned upon.

"while waiting at the traffic lights."

Here's what the article said:
"Foo said the rider, whom he had overtaken once, had suddenly swerved in front of his car."

Apparently there had been some unpleasantness prior to the collision and acc to the driver, after he was hit, the cyclist immediately jumped up and began screaming about sueing.

The sad truth is I see a lot of d1@khead aggressive cyclists every day so I don't find the driver's account altogether unbelievable.

There are some prize drivers out there for sure but most of them actually make an effort not to run us down. A little more respect all around would be a good thing.

Just for once, just for grins... wouldn't you like to be pulled over by some super officious type for "no bell" and reach in your pocket and produce something like this:

255856

Here... 'zat work for ya???

Trial has ended and the judgement is going to be a couple of weeks.

I swapped a couple of emails with the rider (he's the head of the local cycling advocacy group, which incidentally provides training to the police on cycling matters) and he's quite confident.

He says that it was pretty clear that the physical evidence did not back the other guy's story at all. His lawyer made it quite clear in the summary that the ex-cop was very much mistaken (you just can't call someone and idiot or a liar here - the whole 'saving face' thing makes that difficult to do even if it is screamingly obvious).

I hope to have another update when the final decision comes in.

The rider is considering a formal complaint to police depending on the outcome. Failing that he's going to slip the best bits (including the inadmissible stuff) to the tabloid media here!

He won (http://www.scmp.com/portal/site/SCMP/menuitem.2af62ecb329d3d7733492d9253a0a0a0/?vgnextoid=cc527cd1ef588310VgnVCM100000360a0a0aRCRD&ss=hong%20kong&s=news), but has to pay his own costs (which sucks as the prosecutor should have to eat this to learn a lesson about pursuing BS cases).

A high-profile cycling activist who was knocked off his bike in Central by a car driven by a former senior policeman, has been cleared of careless riding. The verdict drew mixed reactions from the legal and cycling communities.

Typical, A cyclist gets charged for obeying the law. While everyone else only gets charged for breaking the law.

He should sue the prosecutor for being an idiot.

But it still comes down to aggressive driving by the larger vehicle. Because if an 18-wheeler did that, to a 2-ton hemi, the driver of the hemi would be reacting the same way as the cyclist in this situation.

Hong Kong = terrible driver skills.

It would be funnier if it wasn't so dangerous!

This has nothing to do with the guy being on a bicycle. He's lucky he wasn't cited for being in the way of a retired Assistant Police Commissioner target shooting at that intersection.

When I was hit buy a car on my bike about 25 years ago, the driver turned left directly in front of me. He didn't get a ticket, but I did for my bike not being registered. :twitchy:Luckily, I did get a settlement from his insurance company.

can the cyclist sue the driver for damages; pain & suffering; punitive damages; court & attorney fees?
