It's either borken, or someone mounted it incorrectly.

There's a stop tab on the upper body to keep it from swinging forward beyond a certain point. I suspect the tab is sheered off, but that's something you need to confirm. If it's just loose and you can remount it so it doesn't swing forward beyond about 45° it might be OK, otherwise it's scrap metal.
