I was almost to the grocery store on my little bike(bmx) when the lady behide me decides she wants to overtake me. I was going a little over 15 miles an hour( a repectable speed limit for a parking lot) and there was maybe a car length between me and the car infront of me. She saw this spot and started to pull ahead but what she failed to see was the car in the lane she was trying to pass in. BANG!. I stuck around to find out if anybody was hurt and called the police. The lady that was behide me got out of her car and started to yell and curse at me stating that I should have been on the sidewalk. Not only did I have the right to the road but I then pointed to the sign posted that read "No bicycling, skateboarding or rollerblading". Finaly, the police arived and straightened everything out. The lady was totaly at fault, and the police said that the other motorist or myself could initiate a claim against her insurance for any damages that occured. I probably won't claim anything but am just so tired of the ignorence and irresponsibilty of some drivers on the road. Thats just my rant for the day.

It amazes me that people are able to get driver's licenses without knowing the basic info about the right of bicycles to be on the roads (and in parking lots).
I must say my area, though not well designed for bicyclists, has drivers that for the most part know you have the right to be on the road. I've been almost one year sans auto, I take every lane that isn't super-wide, and only four people have let me know they think I should be off the road.

Don't beat yourself up too much about it, it happens. People are stupid, what more can I say? I nearly cleaned up a pedestrian (cue, Kenneth) who blindly stepped out onto the road in front of me a few weeks ago, then decided to abuse me as if it was my fault (although his wife did apologise to me). I rode away basically thinking "well, if he's blaming me it's only a matter of time before he does it again, and the next person he does it to mightn't stop -- Darwinism, Good." Funnily enough, the whole incident totally failed to upset me one bit.

Chris you should tell me what clothes you are wearing or where you are so I have time to jump out of the way especially on the footpath.
But of course only when you and Alister have finished trolling the forums, newsgroups, the lists, the blogs etc etc.

Chris you should tell me what clothes you are wearing or where you are so I have time to jump out of the way especially on the footpath.
He usually wears red iirc, but whatever attire he chooses I suspect a 400lb gorilla will be relatively easy to spot.

Had that happen to me once too long ago. Some joker decided the absolute best place to pass me was on a curve at the top of a hill. When the other car coming the other way and there was a nifty little collision. Joker jumped out and started screaming that it was all my fault. I ended up playing peacekeeper since the other way driver was livid about joker trying to blame me for the accident (probably had no fondness for bicyclists, but was flabbergasted by the idiotic passing attempt.) Gave a statement to the police when they arrived, they laughed at joker's attempt to blame me. Police laughing did not calm him down and he strode towards me at one point looking like he was about the start swinging fists. Policeman intercepted him and told him to calm down, then sat him down and explained in how many ways he was wrong, and that he better learn to accept it. Police told me to take off since there was no point in me being there any more. Hopefully a few citations were given to joker.

I'm amazed how many people are clueless to cyclists rights to the road. This is why I think sidewalk riding should be banned in all cities so people won't see bikes anywhere but the road.

You know that the speed limit on a parking facility is only 5 mph's right? I know 15-20 mph is common, but it is speeding even though it is rarely enforced. You have no right bicycling on the sidewalk where pedestrians are traveling 2-3 miles per hour. (I hate it when cyclists ride on the sidewalk) You could not possibly be responsible for the motorists decision and actions. She should have treated you like any pedestrian on the road. A pedestrian in a parking lot road automatically has the right of way. It does not matter how much of a hurry the motorist is in. I am glad the police were there to verify.
