Pictures, for what it's worth:

So there's one major dent and two smaller ones. There's a small crack near a spoke hole. . I found it earlier but couldn't find it again when I had my phone for pictures.
I bought this as used, ebay, caveat emptor. . but then again the seller implied otherwise the condition. . . these could be ancient.

dwellman: Your small crack will grow. I would not ride on a rim I knew to be cracked.

I'll try to find it again. . .
UPDATE
Here it is. Kind of weird I noticed it right away and then when explicitly looking for it twice couldn't find it. . and fourth time found it. . crack or scratch in the anodizing? I'm going with crack.

I emailed Velocity, too. . . see what they have to say about it. Either way I feel I can get the cost of a new rim back. . . hopefully.

If the seller implied the condition to be good...It's the e-bay seller you should be talking to, not Velocity.
I've heard of some Velocity rims suffering from cracks, but haven't seen 'em myself. Velocity may very well take care of it, but really they have no responsibility at this point. You're not the original owner and there's no telling what, or how many owners these wheels/rims have been through.
The rim damage and the crack might be related- maybe not. We have no idea whether the spokes have been properly tensioned. Those are low spoke count wheels so tension might be unusually high to insure or correct rim alignment. There's just no way of knowing with second hand stuff.
With E-bay, you bought it as-is. People shop E-bay to save money. You take a risk and the responsibilty is yours. If you can work a deal with the seller, great. If not your recourse is generally not with the manufacturer. If the hub is good, put a new rim and spokes on it. That stuff is not that expensive. Hope you got aq good deal on it!

I was under the impression, according to the seller, the Wheels were built recently and have less than 1000 miles on them. I am in contact with him. Seems ok. A little flustered, but ok.
My main point is checking with Velocity to see what they say about the "crack" photo. I don't expect them to replace the rim with the sidewall damage*. Velocity Aerohead seem highly regarded and both situations are new to me: I've never had a cracked rim or dented sidewalls before**, but then again I've never bought used wheels before, so. . . anyway I was asking you guys 1) how common is this and 2) significant enough to try to get $50 back from the seller for a replacement rim.
*They seem like nice people, anyway
** Well, a Wolber GTX kinda expand a bit at the (weld?) seam but was fine until a head on crash turned it into a pretzel. Here I am lying on the ground, drifting in and out of consciousness, with bone sticking out of my leg and my buddy standing over me saying, "Hey man, look at your wheel!"
