EDIT: Oh, and bike, me and everything I take with me adds up to about 270Lbs...

It probably depends on your state laws. In most states they are bicycles. I will admit that on my commute my e-bike is not used on bike facilities; because there are none.
Certainly some e-bikers do sometimes operate faster than the conditions allow; but the same can be said for the operators of every other type of conveyance, including shoes. I understand the bike-forums attitude that if, for may reason, a person cannot use a conventional bicycle for their commute, then they should drive. I happen to disagree. It is a fundamental religious difference and it takes on that nature when it is discussed.
